SCAC staff is aware that the Public Interest Foundation intends to mount a legal challenge to the Local Government Fund (LGF) shortfall. The Foundation is attempting to recruit counties and this Association to join in litigation against the General Assembly. SCAC staff has had discussions with the Chairman of Ways and Means as well as Senate Finance staff. It is apparent that they intend on passing legislation and funding the LGF in a manner that either is consistent with, or exceeds SCAC's position. Ways and Means Chairman Murrell Smith clearly plans to work with county government on this and other issues and we appreciate his efforts. Therefore, SCAC staff believes the General Assembly will quickly render any legal action moot. Additionally, it seems doubtful that a legal challenge to the LGF would ultimately be necessary or successful.
