As part of the 2023-2024 State General Appropriations Act (Act No. 84 of 2023), the General Assembly allocated $3 million to provide a $10,000 salary supplement to each full-time magistrate and a $2,500 salary supplement to each part-time magistrate. These amounts will be distributed quarterly to the counties to be provided to the magistrates. SCAC consulted with state budget officials and is of the opinion that these amounts should be treated like any other state salary supplement where payroll taxes and fringe benefits are allowed to be deducted from the amount received by the county before sending the net amount to the magistrate. This deduction is allowed but not required. SCAC advises that each county consult with its county attorney before processing these distributions.
