Amendment to CS/CS/SB 1730:

Proposed Live Local Act Amendment Could Undermine Protections for Historic Districts

CS/CS/SB 1730 (Calatayud) is the Senate bill that expands the Live Local Act. The House is expected to consider the bill TODAY. An amendment has been filed (Amendment 673693) that removes key language previously included in the House version of the Live Local Act (HB 943) that provided additional protections for historic structures located within designated historic districts. This change could significantly impact cities with historic districts containing commercial, industrial, or mixed-use properties.

 

Specifically, the amendment would:

  • Require administrative approval of the demolition of any existing structure associated with a Live Local Act project, so long as the demolition complies with all applicable state and local laws.
  • Limit height restriction authority only to situations where a structure is individually listed in the National Register of Historic Places. In such cases, a city may restrict the height of a proposed development to the tallest existing commercial or residential building within a ¾-mile radius.

 

This means cities would not be able to apply the additional height restriction protections in this bill across an entire historic district – only to parcels with a nationally registered historic structure.
