Solid Waste and Mobility Fee Bills Both Pass House Subcommittee
Solid Waste Management (Oppose)
HB 975 (Holcomb) – relating to Solid Waste Management, passed the House Local Administration, Federal Affairs & Special Districts Subcommittee today by a vote of 12-5. Please thank the representatives who voted No on HB 975: Rep. Bartleman, Rep. Daley, Rep. Gottlieb, Rep. Hawkins, and Rep. Woodson. Special thanks to Rep. Hawkins for debating against the bill.

HB 975 was amended to preserve municipal or county franchise fees that were in place as of January 1, 2023, but it limits those fees to the cost of administering the franchise agreement. The amendment also exempted those cities that exclusively self-provide solid waste services within their cities using city employees and equipment for all solid waste functions. This exemption may not protect your city if you self-provide services to some, but not to all, properties in your city. The League remains opposed to HB 975.

Mobility Fees (Support)
HB 235 (Robinson) relating to Mobility Fees also passed the Local Administration, Federal Affairs & Special Districts Subcommittee by a unanimous vote. This bill offers much-needed clarity to local governments regarding the adoption of mobility plans and mobility fee systems.
 
In addition, HB 235 was amended to address League related concerns dealing with impact fees provisions in the bill. The amendment allows impact fees increases for extraordinary impacts so long as there is a demonstrated needs study to support it.
