"Let's Get Down To Businesses "

A provision which prohibits all Business and Commercial Operations may prove problematic, as it may seek to prohibit all business and commercial activities (i.e., operations) within a community. Please appreciate that prohibiting business and commercial activities within communities has become more problematic as technology has advanced. In today's world, countless individuals perform some level of business or commercial activity from their homes. How many of us use our phones and computers on business activities from our homes?


Abused Pets Could Use Your Help!



Our pet donation drive last winter was so successful that we are ready to start another round. These abandoned pets need support just like any other charity, and Clayton & McCulloh is here responding to that call.  We will again be collecting donations at any of our office locations with the donations to each office going to their respective local Humane Society. We all truly appreciate the support all the clients and non-clients that we interact with have shown for this charity in the past and we cannot wait to see what we can all do going forward. 



If you have any old towels, blankets, new pet food, and/or a monetary donation please consider donating them to this worthy cause. These organizations have an especially dire need for cat litter which they told us "is like gold around here." We will b e collecting donations at both our Maitland and Melbourne Offices. Our collection period will end on July 28. Please find it in your heart to help these poor, scared, unloved pets. Donate your old towels, blankets, new pet food, cat litter, resources, and if at all possible - adopt a new member for your family from one of these amazing organizations.

Embracing Community... It's Not Just Our Motto.
 
Embracing Community is what Clayton & McCulloh is all about. One of the ways we do this is by getting to know you and being an integral part of your Community. That's why we want to invite Brevardians to stop by our Melbourne office in the Suntree/Viera area and get to know a member of our Public Relations Team.  Drop in, have a cup of coffee or soft drink and some light refreshments on any of the dates below between the hours of 10:30 a.m. to 3:30 p.m.  As we want to make sure we have enough refreshments (our staff will partake on the sly), please let us know if you are planning on coming by in the a.m. or p.m.

Who's The Most Awesome In Your Association?

The Most Awesome Award for the first half of 2017 has been an "Awesome" success with some very deserving Managers and Board Members. We were absolutely blown away by the response of those receiving this award. The reactions we received have validated our reasoning behind giving out these awards to the Awesome Managers and Board Members in Central Florida. It allows us to exemplify our motto of  Embracing Community to those that deserve it most. Christ Bertoch, Manager of Park Lake Towers 

Penny Jacobs, Treasurer on the Board of Directors for Park Lake Towers, had this to say in her nomination of Chris Bertoch: "Chris gives his 'all' to the Association.  He routinely works after hours to get things done.  He is universally well liked by all residents and owners.  He is respectful of all residents, but he enforces the rules.  Recently, his father passed away and he took some time off, including the weekend before the memorial service. When Chris learned that our fire alarm went off early one Sunday morning, he came in to determine why it had gone off.  Chris contacted our alarm vendor, who showed up that same day and determined we had a short.  Even while grieving, he wanted to make sure all residents of Park Lake Towers were safe. Not only is he awesome, he is respectful, conscientious, smart, organized, and caring."

Gail Joubran, President of Barclay Place at Heathrow Condominium Association

Sara MacDonald, Community Association Manager at Sutherland Management, nominated Gail Joubran saying: "We, at Sutherland Management, are proud to nominate Gail Joubran, President of the Barclay Place Condominium Association, as the Most Awesome Board Member. Gail has been a devoted Board Member since 2005, providing dedicated service to her community well above what is expected from a Board Member. Gail personally oversees most of the maintenance projects that are needed for the Community; serves on the ARB committee; serves on the Leasing Committee; takes time to walk the community on a routine basis making certain everything is in proper order; meets with homeowners to answer questions as well as personally inspects problems/issues with, not only common areas but the

 owners' units and, in general, is always available and willing to do whatever necessary to make certain Barclay Place is a premier community to reside. As her management team, it's a delight to have a board member who is so available to streamline issues that arise periodically as well as work with to make certain everything runs smoothly. Gail absolutely goes beyond all normal expectations of a board member and the community is quite lucky to have her representing their interests."

Rehabilitation Letter Service 
 
Associations routinely find that they have been lax or inconsistent in enforcing covenant, condition, rules or regulations ("Rules and Regulations") of the Governing Documents.  Unfortunately, the Association's ability to proceed with enforcing such Rules and Regulations may have become problematic.  However, all may not be lost, and the Association may be able to re-establish its rights to enforce such Rules and Regulations. To bolster its right to enforce its Rules and Regulations, we recommend that we draft a "Rehabilitation Letter" for the Association to send to each of its owners and occupants.  While the purpose of the letter is much more involved than will be described herein, in essence, the letter apprises all the owners and other  occupants that they can no longer rely upon the Association's past failure to enforce violations or infractions of its Rules and Regulations as a justification for future or continuing violations or infractions.  The "Rehabilitation Letter" endeavors to "restart the clock" such that the Association will be well-positioned to timely, uniformly, consistently and properly enforce its Documents thereafter.   As you might guess, this is a very popular service for Associations that have not been diligent in enforcing their Rules and Regulations.  This is a situation where the Association can obtain a "big bang for the buck."  Additionally, we find that the Rehabilitation Letter also assists with another one of our recommendations, which is to always attempt to build and foster the credibility of the Association. 

All of our fixed rate services have been designed for Community Associations such as yours.  Please understand that these legal services are offered as fixed rates and/or deferred fee services, but our clients are not required to use these services.  These services were created to save the Association money and to provide certainty to the cost of various commonly needed or requested legal (and other) services so Associations could better budget for some commonly needed legal services.  If you would like more information on any of the specific services discussed, please call or e-mail our office and request more information about that service and what services are rendered.  Remember, you are under no obligation to purchase any fixed fee packages.  We do not generally require a mandatory retainer for our Community Association clients.
