Lien Defense Update
Western Medical Center Santa Ana v. W.C.A.B.
Lien On Me, Inc., in conjunction with Floyd, Skeren & Kelly, LLP, successfully litigated the lien of Western Medical Center on the issue of a valid contract.

Judge Blas issued a Findings and Order and Opinion on Decision, wherein he found that there are valid interlocking contracts that bind medical providers to a third party coordinator.  There is a valid contract that binds the provider to the the third party.  The contracts, read together, set forth express amounts of payments providers are to make to medical facilities.  Section §5304 exempts parties from using the Board as an arbiter.  The Judge found that the parties are bound to the terms of the contract.

Reid Steinfeld on behalf of Lien Claimant Western Medical Center filed a Petition for Reconsideration, wherein the higher court affirmed Judge Blas decision.

Reid Steinfeld on behalf of Lien Claimant Western Medical Center filed a Petition for Writ and Review, wherein the appeals court denied on August 11, 2016.
