Kentucky Health Survey Registry


The annual utilization surveys are available for submission of your 2024 utilization data. The survey must be completed by March 15, 2025. Please go to https://prd.webapps.chfs.ky.gov/oigpublic/ to complete the survey. Logging in to the survey requires an identification number (the facility’s license number) and a password. If you are unsure of the password or have questions, please email Michele Bushong at Michele.Bushong@ky.gov

The Kentucky Civil Money Penalty Reinvestment (CMP) Fund

 

What are CMP Funds and how is the CMPRP funded?

CMP stands for civil money penalty. It is a monetary penalty that CMS or the state may impose against skilled nursing facilities (SNFs), nursing facilities (NFs), and dually certified SNFs/NFs for being out of compliance with one or more Medicare and Medicaid participation requirements for long-term care facilities (42 CFR §488.430).

 

What does this Program do?

Also known as the CMP Fund, the program drives improvements in the quality of life and quality of care for CMS certified/dually certified nursing home residents.

 

Who may apply for these funds?

Requests to use CMP funds may be made by any entity, provided the responsible entity:

  • Is qualified and capable of carrying out the intended project or use
  • Is not in a conflict-of-interest relationship with the entity benefiting from the intended project.
  • Is not paid by a federal or state source to perform the same function as the intended project.

 

How may funds be used?

CMP Funds must be used to support CMS approved activities that protect or improve the quality of care or quality of life for long-term care facility residents. This may include any of the following:

  • Assistance to support and protect residents of a facility that closes or is decertified;
  • Consumer Information;
  • Projects that support resident and family councils;
  • Activities that improve quality of care
  • Activities that improve quality of life

 

Is there a funding limit?

Yes. Projects are limited in the amount of funding depending on the category/project type. However, exceptions can be made provided sufficient justification is provided in the application.

For example:

  1. A 1-year project to provide wound care training to direct care staff at 50 nursing homes is capped at a total of $250,000 (5,000 x 50 x 1 = 250,000)
  2. A 3-year project to provide musical therapy to residents at 10 nursing homes is capped at a total of $150,000 (5,000 x 10 x 3 = 150,000)

 

Is there a deadline to apply?

No. Applications may be submitted any time of year.

 

What law(s) govern this program?

Sections 1819(h)(2)(B)(ii)(IV)(ff) and 1919(h)(3)(C)(ii)(IV)(ff) of the Social Security Act (the Act) incorporate specific provisions of the Patient Protection and Affordable Care Act, (also known as the Affordable Care Act (ACA) (Pub. L. 111-148) pertaining to the collection and uses of CMPs.

Informal Appeal of Survey Findings


Every Long Term Care provider has the right to both an informal and formal appeal process following receipt of a completed Form CMS-2567. There are two informal appeal processes: Informal Dispute Resolution (IDR) and Independent IDR (IIDR).

 

Interested in Serving on an IDR Panel?

Kentucky requires one member of the IDR panel to be "a person currently engaged in the provision of Long Term Care services who has no affiliation with the provider disputing a deficiency." Typically, a Long Term Care Administrator is on each IDR panel. There is no payment or travel reimbursement for an Administrator serving on a panel. Administrators will be rotated. If a Long Term Care Administrator is interested in serving on a panel, a confidentiality statement must be signed prior to the participation in the first IDR panel.

All correspondence is handled in the ePOC system, including the plan of correction. Furthermore, if there is a change in administrator, it is incumbent upon the facility to update the system.
