New York Labor Law 27-f – Workplace Opioid Antagonist Requirement
Effective December 12, 2026, New York Labor Law § 27-f requires employers that are already subject to federal OSHA first aid requirements to maintain an Opioid antagonist, such as naloxone (Narcan®), as part of their workplace first aid supplies.
The law applies to employers that are federally required to provide readily available first aid supplies under OSHA standards, including both general industry and construction employers.
What Employers & Workers Need to Know
New Mandatory Training Requirement:
- Maintaining naloxone with existing workplace first aid supplies.
- Periodically inspecting and replacing naloxone prior to its expiration date.
- Training designated employees or first responders in recognizing opioid overdoses and administering naloxone, as required by forthcoming regulations.
- Updating workplace first aid policies and emergency response procedures to incorporate the use of an Opioid antagonist.
Liability Protections:
For employers operating on construction projects, each employer is generally responsible for complying with the law for their own employees. Although a general contractor may also maintain emergency medical supplies on a project, subcontractors should not assume that the general contractor's compliance satisfies their own obligations under Labor Law § 27-f.
Effective Implementation Date:
This new mandate, introduced through Assembly Bill A2725-A and Senate Bill S5922-A, reflects the state’s commitment to combating opioid overdoses in the workplace and ensuring employee safety. The law, codified as Labor Law § 27-f, will take effect on December 12, 2026, following recent chapter amendments signed by Governor Hochul in February 2026.
