I don’t know if Ann Sirmon is a fan of - or if she’s ever heard of - Clara Barton, but she certainly has adopted this philosophy as her own. Next month marks her one year anniversary serving as the MBA Executive Director, and what a year it has been.
Ann came to us from the District Attorney’s Office where she served as Youth and Family Services Director. She had over 20 years of hands-on experience in association management. She also had extensive experience working with non-profits, in public relations, fundraising, volunteer development, and community outreach.
Our mission for Ann was to concentrate on four areas: financial stability, member engagement, community outreach, and modernization, with the understanding that every lawyer examines every bar membership opportunity with the question: “What does this do for my practice or professionalism?” Since Ann came onboard, improvements have been made to the monthly bulletin (we no longer outsource this, she does it in-house, saving us about $500.00 each month), the summer bar social meeting (best attended yet), Facebook and other social media, our notices, and the website. Financially, we are sound. Plans for new benefits are in the works, plus an expanded website that will soon allow us to bring back in-house a lawyer referral system and provide much more information to the public about the services we offer. With guidance from the Executive Committee, and our committee and practice sections, every aspect of MBA membership is being examined, including location and content of our monthly luncheons, CLE opportunities, and additional social gatherings. I don’t know what we would have done without her ideas and planning for the 150th Anniversary.
Ann is capably assisted by our longtime assistant director, Tammy Anderson. We look forward to seeing what the two of you can do with a year under your belt!

Thanks for attending our August Membership Luncheon. It was a HUGE success with a HUGE crowd. Danny Sheridan definitely delivered on sharing his picks. Let’s see if they hold true. We do appreciate Danny's continued support and speaking to the MBA for 33 consecutive years. Wow! Mark your calendars. He will be back in 2020.
Also, thank you to those that participated in our Membership Luncheon Survey. The survey is a great way for your voice to be heard on the direction of your Association. Now that we have collected the data, our next step is to review the information and determine what changes need to be made (if any) to our Membership Meetings. We will keep you in the loop.
We recently held our 12th Annual Family Stars Across the Bay seminar. The event was a big hit! We had excellent speakers, table vendors, a raffle, and a silent auction with the proceeds benefiting The Family Center. I’m happy to report that The Family Center will direct the funds towards their projects and services in both Mobile and Baldwin Counties. A special thanks to Virginia Haas for coordinating and moderating the seminar. You did an amazing job! To everyone, thanks for being a member of the Mobile Bar Association. We appreciate you!

2019 MENTORING PROGRAM
Coffee with the Court

The Mentoring Committee is offering a program for 2019 called
Coffee with the Court
. The concept is to provide a forum for our members to get to know our local judges over a cup of coffee and bagels. At each session, two to three judges will present on the topic:
My Top 5 Practice Pointers for Newer Lawyers in my Courtroom
. All participants receive one hour of CLE credit, as well as coffee. There is no cost for Mobile Bar members with 12 years of experience or less. We welcome all other Mobile Bar members and non-members to join us, and standard CLE rates are charged. Space will be limited. We are asking everyone to register in advance.

The Mobile Bar Association hosted VZC members for its August General Body meeting. During this meeting, the members enjoyed a chat and chew with the President of the Alabama Lawyers Association (ALA). This was an opportunity to discuss collaboration on upcoming projects, as well as the benefits of being a member of the ALA. The Mobile Bar Association also made a presentation on the benefits associated with its bar membership. At the conclusion of the meeting, members toured the Justice Exhibit. The Executive Board extends a warm thank you to the staff of the MBA for its hospitality.
The VZC Executive Board also hosted its retreat at the Admiral Hotel. The President of ALA also participated to discuss VZC's upcoming CLE. The Executive Board extends a warm thank you to Attorney Mary Stone for serving as a sponsor for this event.
Lastly, the VZC Executive Board hosted a membership BBQ to show appreciation to its membership. This event was held at the Dog River Park. The Executive Board extends a warm thank you to Attorney James Brandyburg for serving as its sponsor for this event.

In a case of first impression, the Supreme Court in
Ex parte Valley National Bank
, No. 1180055 (Ala., July 12, 2019), held that claims filed under the Alabama Uniform Fraudulent Transfer Act, Ala. Code § 8-9A-1,
et seq.
, sounded in tort rather than equity and thus, no declaratory judgment could be entered in favor of a transferee declaring that the transfer was not a fraudulent transfer. Accordingly, the Court granted a mandamus requiring the trial court to dismiss the declaratory judgment action on this ground.
In a case of apparent first impression, the Court of Civil Appeals in
L.M.F. v. C.D.F.
, No. 2180203 (Ala. Civ. App., July 19, 2019), held that a juvenile court hearing involving custody of a minor failed to utilize required due process when none of the witnesses were placed under oath and no right of cross-examination was afforded. In effect, the Court characterized such a hearing as a “discussion” between the trial court and the guardians ad litem that was “so irregular and replete with error” that the parties may not have realized that it was a proceeding that the juvenile court considered to be a “trial” of the matter. The judgment was reversed and remanded for the juvenile court to properly conduct an evidentiary hearing on the petitioners’ claim.

Lawyers in Recovery (“LIR”) is a fellowship of lawyers who share their experience, strength and hope with each other to hopefully solve their common problems and help others to recover from alcoholism, addiction, depression or similar conditions. LIR meetings are designed to last one hour and start promptly at 5:30 p.m. on the first and third Thursdays of every month at 205 Church Street in Mobile. LIR meetings are modeled on the steps and traditions of Alcoholics Anonymous and participants pledge and place substantial emphasis on anonymity. If anyone needs additional information on LIR Meetings, they can anonymously call the Mobile Bar Association office for referral to a LIR Member who will also keep all communications confidential.

As the year runs down, I’m sure many of us are starting to stress about getting those CLE hours. SAVLP will be offering our annual CLE on October 18. We anticipate that this course will be approved for 3 credit hours including one hour of ethics.
Remember you can get CLE credit for your volunteer hours. Rule 3.9 of the Alabama State Bar Rules For Mandatory Continuing Legal Education, amended in 2017, states that 3 hours of MCLE can be satisfied by volunteering with a an Approved Pro Bono Provider. SAVLP is proud to be an approved provider. One CLE hour is awarded per 6 hours of service. See the CLE 1-6-3 flyer that was included in our annual private bar contribution letter for more information. Our deadline for reporting 2019 hours is September 30th, so be sure to turn in your hours prior to that date. For clinics, your hours are automatically awarded. For time spent on cases, we depend on your status reports to calculate pro bono hours. Be sure to return those to SAVLP so we can appropriately report your time. If you are licensed in Mississippi or another jurisdiction with mandatory pro bono hours, please email Office@savlp.org so that we can get those hours reported as well.

Speaking of clinics, advice clinics are a great way to use your skills to help clients one-on-one. Clients receive advice on a wide variety of civil legal issues. We had two tremendous clinics in August and served 30 clients. We would like to thank our volunteers from the Mobile Monthly Advice Clinic: Attorneys Jennifer Holifield, Thomas Boller, Judson Crump, Jackie Brown, Hendrik Snow, and Dottie Barker (as pictured left to right). In 2017, our Committee had the privilege of interviewing Frankie Fields Smith, who was 80 at the time of the interview and
who was admitted to the Alabama State Bar in 1967. The interview was conducted by Mary Margaret Bailey
.
Ms. Smith is only the second woman attorney to be honored for 50 years of practice in Mobile County, Alabama.
Ms. Smith began her college studies at the Mobile ranch of Alabama State Teachers College, now Bishop State Community College. She received her law degree from Howard University in 1966. She was admitted to the Alabama State Bar in 1967 and began her law career in Mobile County, Alabama, as an associate with the late Vernon Z. Crawford, Esq. She immediately began representing clients in all courts in Mobile and in numerous other counties in the State of Alabama, including Baldwin, Escambia, Conecuh, Choctaw, Wilcox, Covington, and Jefferson
c
ounties. From 1967 to the present, her practice has been in the area of Civil Rights law. Ms. Smith has served on many committees of the Mobile Bar Association but her favorite committee has been with the Mobile Bar Association Volunteer Lawyers Program, of which was a Charter Member. Ms. Smith served from 1975 to 1986 as a Judge of the Municipal Court of the City of Prichard, being the first person of color and first woman to serve as a permanent judge in that court. As a Municipal Court Judge, Ms. Smith served as Secretary-Treasurer of the Municipal Judges Association. After her tenure as a Municipal Court Judge, Ms. Smith was appointed a Special District Court Judge for Mobile County.
Ms. Smith has been honored by many organizations with which she is affiliated, including the Vernon Z. Crawford Achievement Award in 2001 for her contributions to the Cause of Equal Justice; the Alabama Lawyers Association Lifetime Achievement Award in 2007; the Alabama Bar Association Maude McClure Kelly Award for outstanding women attorneys; and the Mobile Bar Association Women Lawyers’ Trailblazer Award.
Ms. Smith was married to the late Wardell Smith Jr., with whom she had two children, Shawnna and Jeneen. She is presently married to Thomas H. Jackson Jr. She is active in the Mt. Shady A. M. E. Zion Methodist Church where she serves as a Trustee and Director of Christian Education. The interview of Frankie Fields Smith by our Committee is of great interest to the members of the Mobile Bar Association.

, died on August 7, 2019. Jerry is survived by his wife of sixty-four years, two children and five grandchildren. A native of Bladon Springs, he graduated from the University of Alabama School of Law and was a founding member of the law firm of McDowell, Knight, Roedder, & Sledge. Jerry practiced law in Mobile for over fifty years. He was a fellow of the American College of Trial Lawyers and served as President of the Mobile Bar Association in 1992.

J R “Jimmy” Meriwether
passed away on July 24, 2019. He is survived by his wife, six children, nine grandchildren, and fourteen great-grandchildren. Jimmy grew up on a farm in Sarasota, Florida and graduated from the University of Alabama School of Law in 1952. He formed Agee & Meriwether, PC in Chickasaw with his partner Owen Agee and practiced there until the day of his passing. He was an active Freemason for over 50 years and a member of the Satsuma United Methodist Church.

Johnny Brutkiewicz,
died on July 24, 2019. He is survived by his five sons, ten grandchildren, and five great-grandchildren. He was predeceased by his beloved wife of sixty years. Don earned his undergraduate and law degrees at the University of Alabama. In sixty-five years of practice he participated in more than 1000 criminal jury trials and 3000 cases making him one of the most active attorneys in Mobile since the 1950’s. Don was a lifelong member of Christ Church Cathedral.

Mary Margaret Bailey
of Frazer Greene was recently elected President of the Alabama Law Foundation. The Foundation is a 501(c)(3) charitable organization affiliated with the Alabama State Bar which was established in 1987 to operate the state’s IOLTA program. Its mission is helping people in need though improving access to justice by providing opportunities, funding, resources, education, and awareness. The Foundation has awarded a total of $20.9 million in grants, including $1.6 million to the South Alabama Volunteer Lawyers Program. Mary Margaret has served on the Foundation’s Board of Trustees since 2010. She became a Fellow in 2014 and is a charter member of its Atticus Finch Society. MBA members

and mother-in-law of Alabama Court of Criminal Appeals Presiding Judge Mary Windom, died on August 17, 2019. She is survived by her two sons, six grandchildren, and seven great-grandchildren. Connie was an avid bingo player and in her later years enjoyed racking up the winnings playing among friends at her assisted living center in Montgomery. She was a long-time member of Dauphin Way Baptist Church in Mobile.

Morrissette, Jr. Sally loved Mobile and was Queen of Mardi Gras in 1955 and President of the Junior League of Mobile. She was also a dedicated member and officer of Spring Hill Presbyterian Church.

, died on August 3, 2019. He is survived by his wife of over fifty years, two sons, and five grandchildren. Stewart graduated from Murphy High School and then Southwestern at Memphis (n/k/a Rhodes College) where he was a golfer. He was affectionately known as “Doc” though he possessed neither a medical license nor a PhD. A lifetime banker, Stewart retired to the western shore of Mobile Bay and then to Spring Hill.

MOBILE BAR FOUNDATION IS NOW ACCEPTING
GRANT APPLICATIONS

The Mobile Bar Foundation is now accepting grant applications for the 2019 year. On an annual basis, The Mobile Bar Foundation awards grants to area non-profit agencies that align their programs and services with the mission of the Foundation. The mission of the Foundation is to support programs and services that improve the legal system, the administration of justice and promote the betterment of the legal profession and Mobile community.
