Empire State Chapter Calls for Hero Act Reform
Joins 48 Leading Business Groups
Upstate United is proud to join with 48 other organizations in calling on legislative leaders to support sensible reforms to the recently passed Hero Act. The joint statement can be viewed below:

“While the NY Hero Act is well intentioned, we are calling on our leaders in Albany to work together to modify certain aspects of the bill that could irreparably harm struggling businesses across the state. By engaging with all stakeholders to advance sensible amendments, including applying this measure only during a declared state of emergency, we can achieve a balance between workplace safety and economic recovery. Helping employers recover and rehire unemployed New Yorkers is more essential than ever. We look forward to working with legislators and leadership to address the flaws in this bill.”

Sweeping New Construction Safety, Building Code Revisions Unveiled
“The contractor community, in partnership with the Department of Buildings, continues to create the world-class conditions whereby craft professionals across the boroughs can do their job well and in a safe, structured environment,” said Brian Sampson, President, Empire State Chapter of Associated Builders & Contractors. “This new set of safety bills will continue our commitment to making sure that New York City has the highest standards for licensed professionals and safety practices in the construction industry. “ 

ABC President Praises NYC's Committment to Highest Safety Standards in the Industry
New Law Requires Contractors to Demonstrate Safety Training & Industry Experience
Brian Sampson, president of the state’s chapter of the Associated Builders and Contractors, a nonunion construction group, commended the city for continuing its commitment to “the highest standards for licensed professionals and safety practices in the construction industry.”

Biden Announces Tax Credit for Small Biz Providing PTO for COVID Vaccinations
On April 21, President Joe Biden announced a paid leave tax credit under the American Rescue Plan Act (H.R. 1319) that will help offset the cost for eligible employers to provide full pay for any time their employees need to get a COVID-19 vaccination or recover from that vaccination.

  • Businesses with fewer than 500 employees reimbursed for any paid time off provided to employees — up to $511/day/employee.

Guidance for small businesses on the tax credit is available on the IRS website.

On March 12, Governor Cuomo signed legislation (S2588A/A3354B) granting public and private employees paid leave in order to get a COVID-19 vaccine. 

  • Grants employees up to four (4) hours of paid leave per injection. Therefore, employees who receive a COVID-19 vaccine that requires two (2) injections are entitled to take up to eight (8) hours of paid time off;
  • Leave must be paid at employee's regular rate of pay; and
  • Time may not be charged against any other type of leave employee is entitled to including, but not limited to, Paid Sick Leave.
New York State HEROES Act Passes Senate
Impacts of this legislation include:

  • Creates an unnecessary regulatory framework for employers and subject them to potential civil penalties and additional costs;

  • Requires employers to permit ‘workplace safety committees’ –mandate the composition and duties of such a committee in identifying and remedying workplace safety issues and can report the company. Applies to all companies 10 employees and more;

  • Mandates the Departments of Labor and Health to implement minimum standards for workplace safety, enforceable through significant fines;

  • Regulations must include protocols on testing, PPE, social distancing, hand hygiene, disinfection, and engineering controls. Employers would be permitted to establish individual regulations for their businesses that exceed state requirements;

  • Sets standards for personal protective equipment, social distancing among employees and standards for disinfecting workplaces.
REMINDER: COVID-19-related Tax Credits for Paid Leave Extended to September 30
On March 11, 2021, President Biden signed H.R. 1319, the American Rescue Plan Act of 2021.

This law extends tax credits for private employers with 499 or fewer U.S. employees that voluntarily decide to provide emergency paid sick and/or family leave according to the otherwise-expired standards in the Families First Coronavirus Response Act’s Emergency Paid Sick Leave Act and Emergency Family Medical Leave Expansion Act.

Tax credits apply to qualifying leave taken from April 1, 2021 through September 30, 2021. Read the Littler Mendelson article to learn more.

The Value of ABC to Members
I was lucky enough to have the honor to serve as the 2016 National Chair of the Associated Builders and Contractors (ABC). When you research ABC on their website, you will notice their mission statement is:

ABC will continually strive to be the leading voice promoting free enterprise within the construction industry. ABC will promote and defend the merit shop philosophy. This philosophy encourages open competition and a free-enterprise approach to construction based solely on merit, regardless of labor affiliation.

It is an association of over 21,000 members covering every corner of our great nation, from Gaum to Maine. During my year as Chair, I got to meet members from nearly all 69 local chapters.

Willmar Electric was a founding member of the Minnesota/ North Dakota chapter. Several members of our company have served ABC in dozens of roles for nearly 50 years.

Last month, I was disappointed when I was told by a couple of companies they didn’t plan to renew their membership in 2021. Both gave the same reason. It is a reason I have heard many times before.

“We don’t see value for our company.”

It isn’t an answer unique to ABC. I have heard it given by others for many organizations we have been a part of over the years.
No matter how many times I hear this answer, it makes me feel a little lonely.

Why lonely?

Because I’m not going to give up because others want to stand on the sidelines. I’m not going to stop working and donating to the causes I think are needed to keep our industry strong.

When people tell me they don’t see the value, I hear them saying, “you keep fighting, you spend your time and resources. We can share in the rewards, but you can pay the price.”

If enough members don’t renew, ABC will have to cut back on what they do to fight on behalf of Merit Shop contractors. But anyone member can drop out, and nobody will see a noticeable drop-off in services. ABC will continue lobbying in Washington DC and in each of the state Capitols on behalf of the people who make up our industry. We will testify at Congress, go to city hall, and support court cases on behalf of free enterprise.

Lonely might be an exaggeration because it’s only a few out of 21,000, so maybe I should find a different word.

I realize some may join solely for business development reasons. Others might join because they see a tangible return on investment from ABC’s service. I think ABC gives us enough value for safety, education, and many other direct items to justify our membership. But the heart and soul of ABC is to “promote and defend the merit shop.” The value of promoting and defend the merit shop is priceless. I can’t measure its value.

We belong to ABC because somebody needs to pay dues to ensure the association can continue to fight the battle surrounding free enterprise in the construction industry in Washington, Saint Paul, Lincoln, and Oklahoma City. (I could list off more state capitals if you like, but I think you get the point).
Others are content to sit on the sidelines. It leaves me feeling…

Grateful.

Why grateful?

Because 21,000 others see the value in ABC. Thank you.
