Rule 3.102(b)
defines Kindergarten enrollment, and since July 1, 2018, 24% of Compact related cases received and documented at the National Office have dealt with this topic.
In one case, a family received orders to move from Hawaii to Washington. However the family wanted to leave Hawaii and return to their home of record in Florida before reporting to their official duty station in Washington, so they could enroll their child in kindergarten.
The family sought clarification as they wanted to enroll their child in kindergarten in Washington, having already been enrolled in school in Florida, their home of record.
The Compact states the child must have been enrolled or attended class in the sending state at the time of transition. In this case the home of record, Florida, is not the sending state, that was Hawaii. This does not preclude the receiving state, Washington from allowing the child to be enrolled but it is not obligated to do so under the rules of the Compact.
