As REQUIRED per the NAR Settlement, offers of compensation will no longer be permitted ANYWHERE on or through the MLS.  This includes communications in the comments (agent or public), Associated Docs, ShowingTime, SentriLock or any other vendor and/or site that is an aggregator.  


Please remove any comments/words indicating OR implying commission/compensation from the Agent or Public remarks such as, but not limited to


Please remove from all Active, Back on the Market, Keep Showing-Contingent, Accepting Backup Offers, Coming Soon, Pending, and Conditional Withdrawn Listing.

The New SEM Paragon MLS Policy & Procedures that include automatic fine(s).

SEM Policy regarding Offering Compensation & Buyer Broker Agreement Documentation

Offering Compensation: Implying any offer of compensation anywhere in the MLS including on Showingtime, SentriLock, Syndicated website or any 3rd party IDX sites is strictly prohibited. Failure to comply will result in removal of the implied compensation by the MLS Board office including without a written or verbal warning an automatic fine: • First offense $500 fine per listing. • Second offense $1,000 fine per listing. • Third offense $2,000 fine per listing including reviewed by the MLS Directors for further action including suspension of the MLS or termination from the Association. (Adopted 7/24)


Buyer Broker Agreement Documentation Request: Agents’ failure to submit the Buyer Broker Agreement as requested by the MLS Board office immediately within the time limited requested will be levied the following fines per listing: • First offense automatic $1,000 notification fine per listing. • Second offense automatic $2,500 fine including reviewed by the MLS Directors for further action including suspension of the MLS or termination from the Association.  Said participant shall be considered inactive until the levied fine is paid in full. (Adopted 7/24) 

Listing Submission Warning Messages

To further help users maintain NAR settlement compliancy, we will be introducing the following warning at listing submission. Users must Accept in order to submit the listing. Note: The warning will only appear at entry and not any edits post submission.

Listing Entry Message

Message: Listing Agent confirms that there are NO references to commission or offers of compensation in the listing information upon entry, will not enter any at any time during the term of the listing contract and agrees to comply with the MLS Rules and National Association of REALTORS® policy and procedures prohibiting any offers of compensation through the Multiple Listing Service. Violations will be assessed against the listing agent.

Note: The warning will only appear at entry and not any edits post submission.

SEM Paragon MLS just implemented a warning message on listing entry for both Agent and Public remarks based on the following trigger words:

Agent Remarks Warning when saving listing: Agent Remarks Message: Content in your Agent Remarks may violate the rules prohibiting the disclosure of any commission or compensation in the MLS. Please verify and Accept.

 

Since the Public remarks looks at more than the key words above such as phone numbers and email address, the warning is as follows:  Content in your Public Remarks may violate MLS rules. Please verify and Accept.

Sellers Concessions Field

The SEM MLS Directors met on Thursday, August 15, 2024 and have decided

to not allow the Seller Concessions Invite fields.


Remember, the fields are still there but members will see an error when saving a listing. SEBAR members will NOT be able to save a listing if they have a value in any of the three fields.

NOTE: Beware of the optics of publicly engaging in discussions on how to circumvent the rules and commission discussions. Remember, social media is NOT private even in private groups, it can be shared.
