Hundreds of organizations have already signed up to oppose the, “Fairness for Injured Patients Act.” Proponents of the misleadingly self-proclaimed Fairness for Injured Patients Act, or Changes to Medical Malpractice Lawsuits Cap Initiative, appearing on the statewide ballot in November, would dramatically impact the cost and delivery of health care in California, but it’s not written by health experts or real-life medical practitioners. Instead it was drafted to allow a few to make millions more from filing personal injury lawsuits. If passed, the law would remove all existing caps on attorney’s fees, resulting in huge financial windfalls for trial lawyers who sue doctors, nurses, clinicians and other health providers for a living. It also creates a new process that prohibits judges from independently verifying the truthfulness of statements made by trial attorneys in the initial court filings.

CMS needs to hear from us and understand that the DIR fees charged by PBMs are not only outrageous, but they are also unpredictable, and non-negotiable. For years, Pharmacy Benefit Managers (PBMs) have been extracting outrageous direct and indirect remuneration (DIR) fees from pharmacies. This includes independent and retail pharmacies, as well as those associated with practices, such as cancer and urology pharmacies. DIR fees have had a devastating effect on pharmacies and patients. Since pharmacies are in the dark about how much the fees for each prescription will be until after dispensing them, they often end up losing money. In some cases, pharmacies have been forced to close. Patients in rural and underserved areas suffer the consequences of this rigged game most acutely, where one pharmacy closing could force patients to have to travel a significant distance to get their medication. The Centers for Medicare and Medicaid Services (CMS) has finally picked up the mantle, showing real interest in meaningfully regulating DIR fees. This is your chance to make your voice heard. By sharing your story about these abusive DIR fees, you can encourage CMS to act.
