MSD Announces the 2024 Tilton Award Recipient! | Plan to Attend the 8th Annual Tilton Award Event on October 18th |
The Medical Society of Delaware together with the Tilton Society are pleased to announce this year's recipient of the Tilton Award, recognizing medical Achievement in Delaware. The award pays tribute to MSD's first President, James Tilton, MD, who was a medical pioneer, innovator, and statesperson. This year's awardee is MSD member Louis E. Bartoshesky, MD. Dr. Bartoshesky will be presented the coveted Tilton Bust at the Tilton Award Ceremony being held on Friday, October 18, 6:00-7:30 p.m. at the University and Whist Club in Wilmington. | | The Congressional recess is in full swing and physician advocates just like you have been taking advantage of the unique opportunities to engage with their members of Congress while they're "back home." This fall the American Medical Association's top federal priority remains reforming Medicare's broken physician payment system, and we need your help! CMS' recent proposed rule has physicians slated for an additional 2.8 percent Medicare payment reduction on January 1. This latest inexcusable cut looms despite the fact that CMS also projects the increase to the MEI to be 3.6 percent in 2025. That's why it's so urgent that Congress work with the physician community to develop long-term solutions to the systematic problems with the Medicare physician payment system and preserve patient access to quality care. FDA Approves, Authorizes Updated mRNA COVID Vaccines | Protect Against Currently Circulating Variants | Today, the U.S. Food and Drug Administration (FDA) approved and granted emergency use authorization (EUA) for updated mRNA COVID-19 vaccines (2024-2025 formula) to include a monovalent (single) component that corresponds to the Omicron variant KP.2 strain of SARS-CoV-2. The mRNA COVID-19 vaccines have been updated with this formula to more closely target currently circulating variants and provide better protection against serious consequences of COVID-19, including hospitalization and death. Today’s actions relate to updated mRNA COVID-19 vaccines manufactured by ModernaTX Inc. and Pfizer Inc. The updated mRNA COVID-19 vaccines include Comirnaty and Spikevax, both of which are approved for individuals 12 years of age and older, and the Moderna COVID-19 Vaccine and Pfizer-BioNTech COVID-19 Vaccine, both of which are authorized for emergency use for individuals 6 months through 11 years of age. Given waning immunity of the population from previous exposure to the virus and from prior vaccination, the CDC strongly encourages those who are eligible to consider receiving an updated COVID-19 vaccine to provide better protection against currently circulating variants. | |

On Friday, August 16, 2024, MSD gathered at Frawley Stadium to cheer on the Wilmington Blue Rocks as they took on the Brooklyn Cyclones. The excitement kicked off at 6:35 p.m., and the night was filled with thrilling baseball action, laughter, and community spirit! Fireworks Spectacular: The night ended with a bang as the Blue Rocks mascot hit the TNT button, lighting up the sky with a dazzling fireworks display. Federal Judge Blocks FTC's Noncompete Ban | FTC Doesn't Have the Authority to Ban Noncompetes by Adopting Broad Rules | A federal judge in Texas on Tuesday this week blocked a rule issued by the Federal Trade Commission (FTC) banning noncompete agreements, saying the agency doesn't have the authority to ban what it deems unfair methods of competition by adopting broad rules. In her ruling, US District Judge Ada Brown argued that even if FTC had the authority to adopt the rule, it didn't justify banning nearly all noncompete agreements. The rule was slated to take effect in September. In April, FTC voted 3-2 to approve a rule banning noncompete agreements. Under the rule, companies wouldn't be able to issue noncompete agreements and would be required to inform employees with existing noncompete agreements that they will not be enforced. Currently, noncompete agreements are used in an estimated 40% of physician employment contracts and are used by many hospitals, health systems, physician groups, insurance companies, and pharmacy benefit managers. According to FTC estimates, banning noncompetes would increase employees' earnings by up to $488 billion over the next decade and could lead to the creation of over 8,500 new businesses each year. The agency also noted that the rule could lower health care costs by up to $194 billion over the next decade. | |
Increased Oropouche Virus Activity, Associated Risk to Travelers | CDC Issues Health Advisory | The Centers for Disease Control and Prevention (CDC) issued a Health Alert Network (HAN) Health Advisory to notify clinicians and public health authorities of an increase in Oropouche virus disease in the Americas region, originating from endemic areas in the Amazon basin and new areas in South America and the Caribbean. Between January 1 and August 1, 2024, more than 8,000 cases of Oropouche virus disease were reported, including two deaths and five cases of vertical transmission associated with fetal death or congenital abnormalities. Countries reporting cases include Brazil, Bolivia, Peru, Colombia, and Cuba. In the United States and Europe in 2024, travel-associated cases have been identified in travelers returning from Cuba and Brazil. As testing and surveillance for Oropouche virus disease increase in the Americas, reports of cases from additional countries are expected. The Health Advisory advises on evaluating and testing travelers who have been in impacted areas with signs and symptoms consistent with Oropouche virus infection. It also raises awareness of the possible risk of vertical transmission (e.g., from gestational parent to fetus during pregnancy) and associated adverse effects on pregnancy and highlights prevention measures to mitigate additional spread of the virus and potential importation into unaffected areas, including the United States. | |
FDA Authorizes First OTC, At-Home Test for Syphilis | Increased Access to First Step of Syphilis Diagnosis | The first at-home, over-the-counter antibody test for syphilis received marketing authorization from the U.S. Food and Drug Administration (FDA) on Friday last week. Biotechnology company NOWDiagnostics, Inc., manufactures the test. The new test, called First To Know, uses a drop of blood to offer an early indication that a person may have syphilis, with results available in about 15 minutes. The results must be confirmed by a doctor. According to the U.S. Centers for Disease Control and Prevention (CDC), reported syphilis cases increased 80% in the United States between 2018 and 2022 (from 115,000 to more than 207,000), continuing a decades-long upward trend. | |
Screening, Supplementation for Iron Deficiency in Pregnancy | USPSTF Final Recommendation Statement | The U.S. Preventive Services Task Force (USPSTF) released a final recommendation statement on screening and supplementation for iron deficiency and iron deficiency anemia during pregnancy. The Task Force found that more research is needed to determine whether or not pregnant people should be screened for iron deficiency or take iron supplements. To view the recommendation, the evidence on which it is based, and a summary for clinicians, please go here. The final recommendation statement can also be found in the August 20 online issue of JAMA. | |
Fluoride Exposure: Neurodevelopment and Cognition | Fluoride at Twice the Recommended Limit Linked to Lower IQ in Children | The long-awaited report released comes from the National Toxicology Program, part of the Department of Health and Human Services, that concludes that drinking water containing more than 1.5 milligrams of fluoride per liter is consistently associated with lower IQs in kids. The report did not try to quantify exactly how many IQ points might be lost at different levels of fluoride exposure. But some of the studies reviewed in the report suggested IQ was 2 to 5 points lower in children who’d had higher exposures. | |
Elinzanetant Shows Significant, Rapid Benefits in Trials | Reduction in Frequency, Severity of Hot Flashes, Improved Sleep and Quality of Life | UVAHealth reports the investigational drug elinzanetant significantly reduces the frequency and severity of hot flashes associated with menopause while improving women’s sleep and quality of life, new UVA Health research published in the prestigious Journal of the American Medical Association shows. The nonhormonal drug, which contains no estrogen, was tested in two phase 3 trials, Oasis 1 and 2, at dozens of locations in the United States, Europe and Israel, including UVA Health. Postmenopausal women ages 40-65 with moderate to severe hot flashes were randomized to receive either 120 mg of elinzanetant daily for 26 weeks or a harmless matching placebo for 12 weeks followed by 14 weeks on elinzanetant. The women who received elinzanetant reported rapid improvements in their symptoms and quality of life. The trials revealed statistically significant reductions in hot flash frequency and severity within the first week in both trials. At the same time, sleep quality and overall quality of life improved in both trials by week 12. | |

DE AG Announces Arrest of Woman Posing as Nurse | Used Another RN's Identity to Obtain Employment as an RN at Delaware Facilities | Attorney General Kathy Jennings announced that a Maryland resident was arrested for allegedly stealing the identity of a registered nurse and then trying to use those credentials to fraudulently obtain employment in Delaware nursing homes. Nicole L. Vanhorn, a/k/a Nicole Van Horn, was arrested on August 19th following an investigation led by the Medicaid Fraud Control Unit (MFCU), a unit within the Delaware Department of Justice’s Fraud & Consumer Protection Division. The investigation followed a report by the Delaware Division of Professional Regulation’s Board of Nursing that Vanhorn—formerly a resident of Middletown, Delaware—attempted to use a Pennsylvania-licensed RN’s identity supported by fictitious educational and professional credentials to obtain a Delaware nursing license. Following the Board of Nursing’s report, MFCU discovered that since at least December 2022, Vanhorn used falsified credentials attempting to obtain employment as a health care professional and managed to obtain conditional employment as an RN at two Delaware long-term care facilities. There is no evidence at this time that Vanhorn treated any patients in Delaware. Anyone with additional information about Vanhorn should contact the MFCU hotline at (302) 577-5000. | |

| | It is with sadness we share that long time MSD member G. Dean MacEwen, MD passed away on August 6, 2024, at age 96. An internationally renowned pioneer in pediatric orthopedic surgery, his contributions to the field have left an indelible mark, influencing countless surgeons and shaping the field of pediatric orthopaedics. Dr. MacEwen earned his medical degree from Queen's University in Kingston, Ontario and completed an internship at the District of Columbia General Hospital. He continued his training at the Campbell Clinic in Memphis, TN. Dr. MacEwen joined A.I. duPont Hospital (Nemours Children's Hospital) in 1958 under the leadership of Dr. Alfred Shands. Over the next three decades, Dr. MacEwen established and elevated the field of pediatric orthopaedics with groundbreaking contributions that include the development and modification of devices to treat scoliosis and congenital hip dysplasia that continue to benefit patients today. He also established screening protocols for hip dysplasia in newborns and scoliosis in school children, improving early diagnosis and treatment outcomes. He established the International Pediatric Orthopaedic Research Fellowship, allowing young orthopaedic surgeons from around the world to study in Wilmington. After retiring from Nemours in 1987, Dr. MacEwen continued his work at the Children's Hospital in New Orleans and later at St. Christopher's Hospital for Children in Philadelphia. His legacy is further cemented by the establishment of the Shands/MacEwen Orthopaedic Care Center, the Shands/MacEwen Endowed Chair of Orthopaedic Surgery, and the Dr. G. Dean and Mrs. Marilyn MacEwen Educational Fund at Nemours. In 2017 a conference room at the former MSD Building was named after Dr. MacEwen and that same year he was presented with the Medical Society of Delaware's Tilton Award. A memorial service will be held at 11 a.m. on October 19th at Westminster Presbyterian Church in Wilmington with a reception to follow. In lieu of flowers, the family requests donations be made to the Dr. G. Dean and Mrs. Marilyn MacEwen Educational Fund at Nemours Children's Health, supporting the education of future leaders in pediatric orthopaedic surgery. TidalHealth's Drive for Mobile Mammography is a fundraising campaign to launch the region’s only mobile mammogram unit, bringing life-saving breast cancer screening services and earlier detection directly to communities — even the doorsteps — of people who need it the most. Many women on Delmarva miss their regular screenings because of financial and transportation restrictions and a lack of care nearby. TidalHealth hopes to have the mobile unit on the road by 2026. It will travel to Sussex County, Delaware, and Worcester, Wicomico, and Somerset Counties in Maryland visiting neighborhoods, workplaces and community centers to provide high-quality mammograms and educational resources in a convenient and comfortable setting. Not All Flood Policies are Equal |
Most homeowners' policies specifically exclude flood coverage. Before determining if they need flood insurance, homeowners should understand what a flood is. FEMA’s definition of flood is: “A general and temporary condition of partial or complete inundation of two or more acres of normally dry land area or of two or more properties (at least one of which is your property).” Also consider that a lender may not require a homeowner to purchase flood insurance. Does this mean the home will not flood? No — when it comes to flood insurance, follow this rule: If you have a zip code, you should have flood insurance. Read more.

Cost Plus Drug's Next Move | Mark Cuban is Shaking up Health Care | Entrepreneur and investor Mark Cuban is interested in disrupting health care to bring about long-term changes for the industry. In an interview with "The Daily Show" host Jon Stewart, he wants to make health care more affordable. Launched in January 2022, Cost Plus Drug Company works directly with drug manufacturers to bypass middlemen and lower prices. For consumers, the price of each drug includes a 15% markup as a profit margin, a $3 pharmacy handling fee and a $5 shipping fee. Cost Plus also transparently displays what it pays for its medicines. The company is now becoming a major disrupter in generic drug pricing. Cost Plus now sells about 2,500 medications, including some brand-name drugs, and it partners with a growing list of health systems. The company now works with at least four PBMs and has a partnership with Coherus BioSciences to sell a biosimilar version of AbbVie’s blockbuster rheumatoid arthritis drug Humira. Cost Plus also now manufacturers its own generic medications and as well as drugs in short supply out of a 22,000-square-foot manufacturing plant in Dallas. Cost Plus initially started to manufacture commercial batches of epinephrine and norepinephrine for patients in the intensive care unit. In July, the Food and Drug Administration approved allowing Cost Plus to temporarily import a syphilis drug that has been in shortage for more than a year. Cost Plus offers its medications through mail order but is starting to partner with retail pharmacies. Cost Plus' approach seems to be making an impact as incumbent pharmacy giants like CVS and Walgreens are now following Cost Plus' blueprint to offer transparent drug pricing. | |

BD BACTEC MGIT 960 PZA Kits
BD sent an urgent Medical Device Correction update regarding the removal of affected BD BACTEC™ MGIT™ 960 PZA Kits. Through internal BD complaint trending and review of internal raw material testing, lots of BD BACTEC™ MGIT™ 960 PZA Kits were identified that may intermittently produce falsely resistant results for pyrazinamide (PZA) during susceptibility testing of Mycobacterium tuberculosis isolates. The current list of affected lots can be found here. Pyrazinamide (PZA) is widely used for the treatment of tuberculosis and its exclusion based on false resistance results can result in a less optimal treatment regimen, including extending the length of treatment and increased risk of medication side effects. Laboratories should immediately inspect their inventory and destroy affected product subject to the recall following their institution’s process of destruction. There are no recommendations for retesting or reviewing previous patient test results.

ICU Medical is updating the use instructions for the Plum 360, Plum A+ and Plum A+3 Infusion Systems due to a manufacturing defect of the batteries, which can result in the life of the battery to substantially diminish. If the pump is running on battery power and there is no AC power backup available, the system may shut down an ongoing infusion and power down sooner than expected with no alarm. This updated notice expands affected products from a March 2023 notice and now includes all replacement batteries manufactured by CSB.
Chest Compression Device Recall
Defibtech, LLC, is recalling RMU-2000 ARM XR Chest Compression Devices due to a problem with the device’s motor that may cause it to stop compressions. The FDA has identified this as a Class I recall, the most serious type of recall. This recall involves removing certain devices from where they are used or sold. This device may cause serious injury or death if you continue to use it.
Undeclared Sildenafil
Veata is recalling lot 230811, Exp 8/11/25 of Endurance Pro Energy Boost capsules. Veata LLC was notified by Amazon that the products were found to be tainted with sildenafil, an ingredient in FDA approved products for treatment of male erectile dysfunction in the family of drugs known as phosphodiesterase (PDE-5) inhibitors. Boulla is also recalling lot number 230811, exp 8/11/25 of Boom Max capsules. Boulla was notified by Amazon that the product was found to be tainted with sildenafil. Products containing sildenafil cannot be marketed as dietary supplements. Endurance Pro capsules and Boom Max are unapproved new drugs for which safety and efficacy have not been established and, therefore, subject to recall. Consumption of products with undeclared sildenafil may interact with nitrates found in some prescription drugs (such as nitroglycerin) and may cause a significant drop in blood pressure that may be life threatening. People with diabetes, high blood pressure, high cholesterol, or heart disease often take nitrates. Among the adult male population, who are most likely to use this product, adult males who use nitrates for cardiac conditions are most at risk. To date, Veata LLC and Boulla have not received any reports of adverse events related to this recall. The products were distributed via the internet and fulfilled by Amazon nationwide.

For the third year in a row, MSD is joining DNREC's Coastal Clean Up at Herring Point, Cape Henlopen State Park in Lewes, taking place on Saturday, September 14th beginning at 10 a.m. (rain date September 21st). New AI modules available
Three modules from the American Medical Association’s new online artificial intelligence learning series on the AMA Ed Hub™ are now live, which completes this series. Targeted towards medical students, the seven-part learning series will also be useful to medical educators hoping to bolster their own knowledge of the principles in artificial intelligence (AI) and machine-learning (ML). This introductory content is also suitable for residents, fellows, practicing physicians and other health professionals.

On December 29, 2022, the Consolidated Appropriations Act of 2023 enacted a new one-time requirement which went into effect on June 27, 2023, for any Drug Enforcement Administration (DEA)-registered practitioner to complete eight hours of training “on the treatment and management of patients with opioid or other substance use disorders.” You can satisfy this training requirement to meet the conditions of the MATE Act through courses offered online by the American Medical Association. If you have not met this specific eight-hour training requirement yet, the deadline to do so is the date of a practitioner’s next scheduled DEA registration submission.
