Labor Day - Monday, September 2nd | A Tribute to the American Worker |
On June 28, 1894, President Cleveland signed into law an act creating a national Labor Day, making the first Monday in September of each year a national holiday. Labor Day is an annual celebration of the social and economic achievements of American workers. The holiday is rooted in the late nineteenth century, when labor activists pushed for a federal holiday to recognize the many contributions workers have made to America’s strength, prosperity, and well-being. The labor movement has brought us closer to the realization of our traditional ideals of economic and political democracy. It is appropriate, therefore, that the nation pays tribute on Labor Day to the creator of so much of the nation's strength, freedom, and leadership – the American worker.
U.S. physicians play a large part in the economic development of this country. According to American Medical Association Economic Impact Studies, physicians contribute more than $2.3 trillion to the national economy, illustrating the significant impact physicians have on our national and state economies through the creation of jobs, the purchase of goods and services, and the generation of state and local tax revenue.
In observance of this national holiday, the MSD office will be closing at 2 p.m. on Friday, August 30th and will resume business on Tuesday, September 3rd at 8:00 a.m. MSD staff wish all our members a safe and enjoyable Labor Day holiday.

International Overdose Awareness Day | Senate Joint Resolution 8 designates August 31, 2024, as "International Overdose Awareness Day" in the State of Delaware and requires the state flag to be flown at half-staff at state facilities in observance. By recognizing International Overdose Awareness Day, the Joint Resolution affirms the importance of overdose awareness, remembers those who have died from overdose, and acknowledges the grief suffered by losing a loved one to overdose. | |
Governor Signs Allergy Prevention Bill | MSD-Adopted Resolution Similarly Addresses Food Allergy Prevention |
| | An Act to amend insurance coverage of allergen introduction of both peanut and egg protein to infants was passed in June and was signed by Governor Carney today. House Bill 274 requires that all health insurance plans subject to requirements under Delaware, including Medicaid, provide coverage at no cost when prescribed to infants, of at least one early peanut allergen introduction dietary supplement and at least one early egg allergen introduction dietary supplement. MSD's resolution "Addressing Health Disparities in Food Allergy Prevention," introduced by Sunjay A. Shah, MD; Randeep S. Kahlon, MD; and Sangita P. Modi, MD, was adopted by the MSD Council at its Annual Meeting in 2022. The resolution directs MSD to support efforts by the Delaware State Legislature to provide education to families on food allergy prevention and create access to infant-safe peanut and well-cooked egg protein for all infants. Budget Neutrality Reform Bill Introduced in US Senate | Medicare Physician Payment Reform | The “Physician Fee Stabilization Act” would increase the budget neutrality threshold under the Medicare Physician Fee Schedule from $20,000,00 to $53,000,000 in 2026 and provide regular indexing to the Medicare Economic Index. Overhauling the Nation's Organ Transplant System | HRSA Announces OPTN Board Independence from UNOS | Today, the Health Resources and Services Administration (HRSA) announced that for the first time in the 40-year history of the Organ Procurement and Transplantation Network (OPTN), the OPTN Board of Directors—the governing board that develops national organ allocation policy—is now separately incorporated and independent from the Board of long-time OPTN contractor, the United Network for Organ Sharing (UNOS). HRSA has awarded an OPTN Board Support contract to American Institutes for Research to support the newly incorporated OPTN Board of Directors. | |
Eli Lilly Releases Zepbound Direct to Patients with Prescription | Self-Pay Pharmacy Provides Single-Dose Vials at Reduced Cost, Expanding Access | Eli Lilly and Company announced Zepbound® (tirzepatide) 2.5 mg and 5 mg single-dose vials are available for self-pay for patients with an on-label prescription, significantly expanding the supply of Zepbound in response to high demand. The single-dose vials are priced at a 50% or greater discount compared to the list price of all other incretin (GLP-1) medicines for obesity. This new option helps millions of adults with obesity access the medicine they need, including those not eligible for the Zepbound savings card program, those without employer coverage, and those who need to self-pay outside of insurance. Lilly has created a new self-pay pharmacy component of LillyDirect, a telehealth platform the company launched in January, where patients with a valid, on-label prescription from the health care professional of their choice can purchase the vials. A multi-step verification process will help ensure the vials are dispensed only to patients who have a valid, on-label electronic prescription from their health care professional. | |
$100 Million Awarded to Help with Health Coverage Sign up | Westside Family Healthcare Awarded Funding as Navigator Offering Assistance | The Biden-Harris Administration announced it is awarding a new round of $100 million to organizations vital to helping underserved communities, consumers, and small businesses find and enroll in quality, affordable health coverage through HealthCare.gov, the Health Insurance Marketplace®. The Centers for Medicare & Medicaid Services (CMS) is awarding the grants, in advance of this year’s Marketplace Open Enrollment (which begins November 1, 2024) to 44 Navigator grantees in states using HealthCare.gov. In Delaware, Westside Family Healthcare was one of the 44 grantees for this project. Navigators offer free assistance to people exploring health coverage options through HealthCare.gov, from reviewing available plans to assisting with eligibility and enrollment forms, and post-enrollment services such as using their coverage to get care. Navigators can also assist people in helping enroll in or renew Medicaid and Children’s Health Insurance Program (CHIP) coverage. Navigators are vetted and trained to provide support for the millions who have enrolled in ACA coverage under the Biden-Harris Administration. | |
ACIP Flu Vaccination Recommendations | Guidance for the use of flu vaccines for the upcoming season has officially published. For the 2024-2025 flu season, ACIP recommends annual flu vaccination for everyone 6 months and older. All U.S. flu vaccines this season will be trivalent (three virus) vaccines and were updated from last season’s vaccines to provide optimal protection. Adults 65 years and older should receive an adjuvanted or higher dose flu vaccine, if available. Solid organ transplant recipients can get the high dose or adjuvanted flu vaccine. Recommendations for Mpox Specimen Testing | CDC Announcement to Clinical Laboratory Professionals |
On August 7, 2024, the U.S. Centers for Disease Control and Prevention (CDC) issued a Health Alert Network (HAN) Health Update about the ongoing mpox outbreak in the Democratic Republic of the Congo (DRC) and its spread to neighboring countries. The first Health Advisory about this outbreak was released in December 2023.
For all laboratories performing mpox testing using an orthopoxvirus or monkeypox virus (MPXV) generic test without any additional clade-specific testing occurring, CDC recommends that laboratories send clinical specimens collected from patients who traveled from DRC, its neighboring countries, or any country with clade I mpox cases, or had close or intimate contact with symptomatic people from these countries, to a laboratory that can perform clade-specific testing as quickly as possible. If clade-specific testing is warranted but is not available in a jurisdiction, specimen submission to a capable public health laboratory or to CDC is encouraged. Specimen submission to CDC can be coordinated through your state or local health department. Due to mutations that may impact clade-specific PCR tests, laboratories should use a test that targets a viral essential gene (e.g., the CDC NVO test) as part of a testing strategy to ensure mpox cases are not missed.

Toolkit for AI Assessment in Public Health Released by WHO | Helps Countries Examine Readiness to Implement AI Equitably and Effectively | The World Health Organization (WHO), IDB and the Pan American Health Organization (PAHO) released version 2.0 of its "Artificial Intelligence in Public Health Readiness Assessment Toolkit," highlighting how countries can gauge their preparedness to implement AI projects into their public health strategies. The 62-page report consists of 10 sections, which include questions for countries to assess their readiness to implement AI and considerations and guiding principles for successful implementation. There is also a section with a link to a policy document that provides key concepts, indicators for monitoring AI implementation, and recommended actions to advance interoperability. The toolkit aims to help countries understand how to integrate AI into their health systems by providing a framework for analyzing various aspects of their infrastructure, data management, public engagement, evaluation, implementation, workforce and funding. | |
Updated Poster for Hospital Posting of EMTALA Rights | For Patients to Know Their Rights | The Centers for Medicare & Medicaid Services (CMS) released a new poster for hospitals to display for patients to know their Emergency Medical Treatment & Labor Act (EMTALA) rights, as well as a Quality, Safety & Oversight (QSO) memo for State Survey Agency Directors announcing the release of the poster. CMS regulations require Medicare-participating hospitals to post signage outlining patients’ rights under EMTALA in the emergency department and areas where patients will be examined or treated, or wait to be examined or treated, for emergency medical conditions (EMCs). The poster, which can be viewed in the “Downloads” section at the bottom of the linked page, includes information about patient rights through EMTALA and how to file a complaint if patients believe their rights have been violated. Hospitals are encouraged to use this updated model signage in emergency room departments and other hospital settings to meet the required posting obligations. | |
CMS Updates Health Equity Disparities Impact Statement | CMS updated the Health Equity Disparities Impact Statement, which is posted online and was sent to partners via listserv. This tool can be used by all health care stakeholders to identify and address health disparities while improving the health of all people, including people with disabilities, sexual and gender minorities, racial and ethnic minorities, individuals with limited English proficiency, and those who live in underserved areas. | |

CPT Assistant Editorial Board members help physicians and clinical support staff understand proper use of the code set by reviewing the contents of each issue of CPT Assistant, the official source for Current Procedural Terminology (CPT) coding guidance. Current openings for the CPT Assistant Editorial Board include a new at-large seat for applicants outside of the national medical specialty societies, such as coding certification organizations and others heavily involved in coding education. Bayhealth has partnered with the Delaware Public Health Association’s Delaware Academy of Medicine and the Sussex County Health Coalition to present the Early Fall 2024 Delaware Mini-Medical School series. This virtual experience is a free, six-week course designed for middle school, high school and undergraduate students who are interested in a health care career path and want to learn more about the various opportunities available. The virtual session will be hosted in an online classroom setting on Wednesday evenings at 6:30 p.m. from September 11 through October 9. Each session will feature an in-depth lecture with a Bayhealth subject matter expert, followed by time for questions. The topics include cardiology, health informatics, anesthesia, emergency medicine, radiology, and psychiatry. Participants who attend all six sessions will receive a signed certificate of completion and the opportunity to join the Delaware Youth Medical Academy.

Normalize, Support and Celebrate PTO |
Even when well intended, overinterpreting or misinterpreting regulatory requirements can lead to extra work and unneeded documentation. Clinicians and practice leaders who ask why they have to do a process in a certain way often hear the same explanation: "It's a regulatory requirement." When you hear this, respond with: "Please show me that regulation and where it comes from." The answer may improve everyone's understanding and often helps identify unneeded processes or rules.

2024 Payments for Alternative Payment Model Participants | Important! September 1 Deadline | Each year since 2019, hundreds of thousands of physicians have received lump sum bonus payments equal to 5% of their Medicare payment schedule revenues from the previous year due to their participation in Medicare APMs. Physicians who believe they achieved QP status in 2022 but have not yet received their payment should download the “2024 QP Notice for APM Incentive Payment” zip file as soon as possible. There is a September 1 deadline to provide updated information to CMS. Read more. | |

ClotTriever XL Catheter
Inari Medical is updating use instructions for the ClotTriever XL Catheter after discovering serious adverse events caused when the device becomes entrapped or blocks the lung arteries (pulmonary emboli). These events occurred in patients who had:
- The catheter inserted through the vein above the collarbone (venous access through the jugular vein)
- A clot (thrombus) that is tough, scarred (fibrotic), thick and dense (organized), and/or attached to the vessel (adherent)
- A clot formed in the blood vessel by tumor cells (tumor thrombus)
- An extremely large clot that can’t be removed in pieces (excessive clot volume with an inability to sequentially remove it in pieces).
The U.S. Food and Drug Administration (FDA) has identified this as a Class I recall, the most serious type of recall. This recall involves updating instructions for using devices, and does not involve removing them from where they are used or sold.

New AI modules available
Three modules from the American Medical Association’s new online artificial intelligence learning series on the AMA Ed Hub™ are now live, which completes this series. Targeted towards medical students, the seven-part learning series will also be useful to medical educators hoping to bolster their own knowledge of the principles in artificial intelligence (AI) and machine-learning (ML). This introductory content is also suitable for residents, fellows, practicing physicians and other health professionals.

On December 29, 2022, the Consolidated Appropriations Act of 2023 enacted a new one-time requirement which went into effect on June 27, 2023, for any Drug Enforcement Administration (DEA)-registered practitioner to complete eight hours of training “on the treatment and management of patients with opioid or other substance use disorders.” You can satisfy this training requirement to meet the conditions of the MATE Act through courses offered online by the American Medical Association. If you have not met this specific eight-hour training requirement yet, the deadline to do so is the date of a practitioner’s next scheduled DEA registration submission.
