Victory in Litigation against UnitedHealthcare
In October, MSNJ joined litigation (represented by Mandelbaum Salsburg) filed by several physician practices against UnitedHealthcare (UHC) regarding unilateral non-renewal letters to physicians in New Jersey who participate in the UnitedHealthcare MA Plan. On March 27, after numerous arbitration battles, UHC confirmed that it will reinstate all of the physicians in the case and include them in UHC’s provider directories. Read more .

CMS Issues Stark Law Blanket Waivers in Response to COVID-19
CMS has issued blanket waivers of sanctions under the Stark Law (federal physician self-referral law) in response to the COVID-19 pandemic. The Stark Blanket Waivers are retroactive to March 1, 2020, and will protect only payments and referrals that are related to a broad set of “COVID-19 Purposes.” Read more .
MIPS Reporting Relief
CMS is providing additional relief options for 2019 MIPS reporting due to COVID-19. Practices can submit an Extreme and Uncontrollable Circumstances application until April 30, 2020. An application submitted between April 3 and April 30, 2020, citing COVID-19, will override any previous data submission. Please note, CMS has updated the QPP Participation Status Tool so eligible clinicians can see if the policy has been automatically applied.
CMS Video on Medicare Coverage and Payment of Virtual Services
CMS released a video providing answers to common questions about the Medicare telehealth services benefit. CMS is expanding this benefit on a temporary and emergency basis under the 1135 waiver authority and Coronavirus Preparedness and Response Supplemental Appropriations Act. Watch the video .
AMA Suspends June 2020 Annual Meeting in Chicago
AMA has suspended its Annual Meeting in Chicago in June due to COVID-19. Their officers and board will remain in their current positions until further notice. Read more .
