A message from the President

Greetings, MVAR®!

It’s September now, and as the Summer draws to a close and we begin to wrap up our year, I felt it essential to sharing some thoughts on the growing conversation surrounding our industry and the uphill battles we, as REALTORS® face in the coming months.

By now, you may be aware that recently in a complete breach of legal precedent, the Department of Justice backed out of an agreement with the National Association of REALTORS® meant to state pro-consumer information more explicitly about the Multiple Listing Service (MLS) system and associated real estate commissions. Given this abrupt move by the DOJ, it’s important to remind consumers how the real estate commission system works, how it benefits them and how competitive it is.

For those of you who were able to hear Collin Mullane’s RPAC speech this past month, you can begin to understand the gravity of the conversation surrounding these issues. The real estate commission structure is so competitive that brokerages are competing every day on compensation and customer service all to the benefit of both buyers and sellers. It’s important to understand there is no set rate; every sale is unique and can be negotiated at any time. This gives consumers many different choices. In fact, because of the increased competition among brokers, Real Trends, a Colorado-based research firm, cited that the average commission slid to the lowest ever: 4.94 percent in 2020.

The real estate commission structure also ensures greater access for first-time, low-income and many other home buyers who otherwise couldn’t afford a home purchase and professional representation. In fact, 24% of potential home buyers in 2020 already had to delay purchasing a home by more than five years because of the potential debt and 31% of those were first-time homebuyers. For many, saving for a down payment is difficult enough and paying their brokers’ commission would put homeownership out of reach or force them to go through the process on their own.

And given the internet only does so much, being able to work with a real estate agent is critical for those very same buyers as they try to traverse complicated, data-heavy and voluminous information, details and decisions. That includes everything from coordinating with lenders, and managing attorney and inspection reviews to arranging appraisals and advising on zoning. Without professional representation, you are leaving yourself vulnerable to not getting what you want and making a mistake that can have lasting consequences on your financial health. 

The real estate commission structure plays an integral role in the success of the MLS. Together, they foster cooperation between brokers providing the best and greatest number of options for buyers and sellers. MLSs also level the playing field, allowing small business brokerages to compete with large ones by having all properties listed in one location and providing equal access to the same listings, information, and pool of buyer brokers. The MLS model in the United States is unique in how it shares the maximum amount of information about listings to expose it to the largest number of potential buyers. In other countries, the market is dominated by a small number of individual brokerages who are not required to publicly share that information, so you end up with a system that is very fragmented and inefficient.
The U.S. real estate commission structure and MLSs work for everyone from first-time home buyers to small business brokerages. This system has staying power because it’s grounded in consumers’ best interests with a cooperative system that prioritizes and benefits buyers and sellers alike.

While we certainly cannot resolve these concerns today, we can and should begin to speak so clearly that our message cannot be misunderstood. Realtors are professional, ethical, kind, truthful, accurate and respectful; it is our mission and privilege to assist people from every corner, as they enter into the dream of homeownership. Realtors are there to help businesses secure their first lease, or graduate to the ownership of a commercial building. We are here to serve our community & our Country through the acquisition of land.

There is no greater time or need to use your voice to elevate our industry than right now. Your investment into RPAC ensures more than just your ability to continue to serving your clients, it ensures fair and equal housing for all.

A message from the Community Foundation

Happy September from your Community Foundation!  We are soooooooooo excited to be involved with the “Y” and participate in fundraising for our community center.  So far we have raised $3,570 toward the $10,000 member challenge.  Don’t forget to go to the MVAR website and make your donation!   If everyone does just a little bit, we can make huge progress. 

Geneva Financial is also joining us in the fundraising for the “Y.”   They are hosting Sidewalk Talk – the forth Thursday of every month at 388 State Street in the alley. It’s a wonderful event - great raffle prizes, a drink and a snack, 50/50 tickets, and good company.  It’s worth stopping in for a few minutes and saying hello to our colleagues.

The Mid-Valley Association of Realtors Community Foundation has been very busy taking care of Foundation business as well.   This month we had a “Meet and Greet” to add additional members to our Board of Directors. We were so excited to have 5 REALTORS® express interests in becoming members. They shared their heart with us and we are looking forward to adding some new folks soon. 

A subcommittee also worked through review of the by-laws and got them up to date with approval at the August meeting of the Board of Directors.  The last time bylaws were updated was in 2012!  Your foundation is hard at work for you.  We’re excited to keep everything rolling and as normal as we can in this very interesting time.

The commercial real estate market, particularly the office market, faces increasing headwinds from the negative impact of the surge in Delta variant cases on the economy.
Manufacturing production and new orders, an early indicator of economic growth, is slowing. Businesses have pushed back office re-entry plans.

Expect elevated vacancy rates in the office market but low vacancy rates in the multifamily, industrial, and retail market in the next 12 months.

A partial list of helpful hints from discussions at the Principal Broker Forum July 30th 2021:
  1. REALTORS® identify yourself during calls/text/emails
  2. Read private remarks PRIOR to calling agents with questions
  3. NEVER contact seller directly without instructions to do so by Listing Broker
  4. Require a business card and a copy of ID prior to giving Non-member access or showing
  5. Set up inspection appointments appropriately and don't leave them - recent example of agent leaving. Homeowner was in shower and very startled!
  6. Fill out offers completely
  7. Return rejections
  8. Call Principal Broker if issues occur with licensee
  9. Delivery of acceptance is critical. Offers and counters not accepted until delivered.
  10. When DocuSign is used, customers often miss the radio buttons, so the form is incomplete.
  11. Terms like "simultaneous close" are problematic.
  12. Counsel against waiving inspection contingencies.
  13. Avoid listing property details and terms differently in different MLS's - misleading
  14. New field in WVMLS coming: "Showing Service Link"

If you missed our Code of Ethics class in March, as a member benefit we will offer another Code of Ethics class in the fall-winter season 2021.

Don't forget - REALTORS® are required to complete Code of Ethics training of not less than 2 hours, 30 minutes of instructional time. The training must meet specific learning objectives and criteria established by the National Association of REALTORS®. Below are the cycle dates for the Code of Ethics Training Requirement. Training must be completed at anytime during these established cycles. Current Cycle = January 1, 2019 to December 31, 2021 Check your Status Here.

A Message from the Executive Officer

Hello REALTOR® and Affiliate Members,

Welcome to September! Not exactly sure where August went to, and just a blink of the eye it is now gone. The RPAC Masked Leaders Campaign officially ended at midnight August 31st! We want to thank each member who participated and invested in RPAC. Rest assured we will be updating you with the winning team and who has won the gift card to their favorite team store! At this writing, it appears we have a ways to go to reach our goal of $35,000 by end of year. That said, A J Nash, Zach Fischer and Drew Johnson will be reaching out to you and who knows they may be back with something more challenging to raise RPAC funds and protect Home Owners rights and your Real Estate business.

We continue to be challenged in very unprecedented times and shift to what is best for our members when considering meeting in person or offering educational classes virtually. All we can do is continue to shift when necessary for the safety of all.

Amazing event and we are so grateful of the money raised! Thanks to so many! Don't forget you can make a difference to by making a donation to the challenge and the Foundation will be matching up to $10,000 of the Association Member's contributions to support the next 100 years of the YMCA. Lets show our community how REALTORS® make a difference.

License Expiration on a Weekend? Don’t Wait Until the Last Minute
Does your license expire in any of the following months: July 2021, October, 2021, April 2022, July 2022, or December 2022? License expiration dates are always the last day of the month. Anytime your license expiration date is on Saturday or Sunday, we suggest you start your online renewal application in eLicense before the weekend. That way, if you have questions during the application process, there is time to contact the staff at the Oregon Real Estate Agency for help during business hours.
