These unpaid internships are available for undergraduate, graduate, and law school students, giving them practical experience in the criminal justice system, a strong work ethic, and college and law school credits towards their degree. Law school student interns participate in courtroom proceedings and gain invaluable knowledge and experience. Pursuant to Michigan Court Rule 8.120, law school students are given the authority to appear and represent the People of the State of Michigan in court proceedings under the supervision of an assistant prosecutor.

Not everything is quantified by money,” said Macomb County Prosecutor Peter J. Lucido.

The Macomb County Prosecutor’s Office Internship Program gives students real world experience. Undergraduate interns will experience a professional office environment, learn how to work with others, gather knowledge of the criminal justice system, and create a strong work ethic. They will provide administrative assistance to Prosecutor Lucido and staff in areas ranging from communications, general office administration, and special projects while having the opportunity to learn and experience the prosecutorial process.

Macomb County Prosecutor's Office Pioneers Mental Health Assessments as Key Strategy in Tackling Gun Violence

The Macomb County Prosecutor’s Office has taken positive steps to address the growing gun violence numbers in Macomb County by requesting mental health assessments as a condition of bond. Macomb County Prosecutor Peter J. Lucido implemented his gun policy on February 22, 2023. New red flag state laws do not take effect until January 1, 2024.

"Addressing gun violence requires proactive measures and a focus on mental health. By requesting mental health assessments as a condition of bond, the Macomb County Prosecutor's Office is taking positive steps toward reducing gun violence. We recognize the importance of early intervention and ensuring that individuals with mental health issues receive the necessary treatment. Through comprehensive evaluations and responsible decision-making, we can create a safer Macomb County for all," said Macomb County Prosecutor Peter J. Lucido.

Governor Gretchen Whitmer signed into law red flag laws, a process to temporarily remove firearms from at-risk individuals. This new law allows family members, partners (current or former), mental health professionals, or other eligible petitioners to file a complaint against a person to take away their firearms. The petitioner must show the person can “reasonably be expected within the near future to intentionally or unintentionally seriously physically injure himself, herself, or another individual by possessing a firearm.”

Once these laws take effect in January 2024, the court would need to consider several factors in determining whether the red flag protection order is necessary. These factors include previous convictions, pending charges, threats, other crimes, any previous unlawful possession, and the use, display or brandishing of a deadly weapon. The criteria used to determine if the protection orders are necessary corresponds with the existing Macomb County Prosecutor’s Office policy to request a mental health evaluation as a condition of bond in gun crime cases.

At arraignment hearings, Macomb County assistant prosecutors request judges to order all felony gun crime arrestees to receive a mental health assessment as a bond condition. Alcohol and drug screening is regularly done at arraignment. A mental health screening for felony gun defendants is equally important.

After arraignment and release on bond, a defendant’s case may not be tried and finalized for over a year. This is far too long to allow someone with a mental health issue to go unevaluated and remain untreated. Allowing such a situation to exist puts society at risk. In 2022, the Macomb County Prosecutor’s Office had 308 felony firearm cases and 551 carrying concealed pistol felony cases where this policy would have recommended a mental health screening. Mental health treatment and the reduction of gun crimes is of utmost importance.

Judges have full discretion to grant or deny assistant prosecutors’ requests for mental health assessments, but if the red flag laws were implemented against the same person the judge would have to order an assessment. It is essential to note that the Macomb County Prosecutor’s Office is not asking the Community Corrections Dept., Community Mental Health Dept., or any mental health professionals to substitute their judgment for a judge’s decision.  A mental health assessment will give helpful information to judges who decide daily whether a defendant will pose a risk to the community.

When the accused is charged with a gun crime, should they have a mental health assessment?
