The 5th Circuit Court has stayed the implementation of the mandate as a result from a lawsuit filed by the ATA and state trucking associations based on the fact that OSHA did not satisfy the statutory requirements for issuing the Emergency Temporary Standard instead of going through the rulemaking process.

Trucking trade group to Gov. Newsom: Enforce law on port fees

The Western States Trucking Association is asking California governor to enforce 2005 law which relieves small trucking companies from be charged per-diem and demurrage fees under certain circumstances such as port congestion issues.

Vax mandate catches truck drivers in jurisdiction crossfire between OSHA and DOT

According to attorneys, professional truck drivers on the road are subject to DOT regulations, not OSHA. However, the rules get blurry if that driver goes to the loading dock at a delivery.

FMCSA is amending its regulations so that state driver's license agencies must not issue, renew, upgrade, or transfer a CDL or permit due to one or more drug and alcohol program violations.
