Major Florida HOA Changes in 2026

New HOA reforms are coming to Florida. Here’s what homeowners, buyers, and real estate professionals should understand.

What This Means for Homeowners, Buyers, and Real Estate Professionals

Florida is entering one of the most significant regulatory shifts in community association governance in years.

Following reforms that began in 2024, state lawmakers are now advancing additional legislation—including HB 657—aimed at increasing transparency, accountability, and homeowner rights within HOA communities.

For homeowners, buyers, and real estate professionals, these changes could have real implications for property values, financing, and community governance.

 Expanding Homeowner Power

One of the most notable proposals would allow homeowners to dissolve an HOA with a two-thirds majority vote.

Historically, HOA structures have been difficult to modify or dissolve. This proposed change signals a significant shift toward greater control by property owners and could reshape how some communities operate in the future.

For homeowners, this introduces a new level of influence over how their communities are governed.

Increased Board Accountability

Another key focus of the reforms centers on accountability for HOA boards.

Proposed measures introduce potential criminal penalties for board members in situations involving:

• Fraud

• Misuse of association funds

• Failure to meet transparency and reporting requirements

These provisions are intended to address longstanding concerns around oversight and financial mismanagement within some associations.

Greater Financial Transparency

HOAs are also expected to face stricter financial disclosure requirements.

This includes stronger oversight regarding:

• Reserve funding

• Budget transparency

• Financial reporting to homeowners

For buyers, these disclosures will become increasingly important when evaluating the true cost of ownership beyond just the mortgage payment.

New Dispute Resolution Framework

Florida lawmakers are also exploring the creation of a specialized “community association court.”

This framework would help streamline disputes related to:

• HOA fines

• Governance decisions

• Rule enforcement

• Owner-association conflicts

The goal is to create a more efficient and structured process for resolving HOA disputes across the state.

What This Means for Real Estate & Lending

From a financing and real estate perspective, these changes could have meaningful effects across the housing market.

Key considerations include:

• Buyers may need to review HOA financial health more carefully

• Lenders may scrutinize reserve funds and HOA stability more closely

• Communities with weak reserves or governance issues could see declining demand

• Well-managed associations may become significantly more attractive to buyers

In other words, HOA quality may become an even bigger factor in real estate decisions.
