The dirty little secret: discipline is associated with over 55% of our liability.


If that statistic sounds absurd to you - you are not alone. But here's the reality: the fire service despises discipline - it offends our culture - to the point that we have very little training in it.


Discipline is involved in 7,475 of the 13,527 cases in my Fire Service Litigation Database. That is 55% of our litigation.


This includes:

  • Firefighters challenging discipline
  • Firefighters alleging that that the department failed to discipline the perpetrators of sexual harassment, race discrimination or other forms of discrimination
  • Civilians alleging they were harmed by the misconduct of on-duty personnel that the department knew about but failed to control


From the department's perspective, are we prepared to address the challenge? From the union's perspective, are we prepared to hold the department accountable to handle discipline properly in a fair and objective manner?

Advanced Disciplinary Challenges

in the Fire Service

March 11-12, 2025

This 2-day program is a deep study into the causes of, and solutions for, discipline - related problems in the fire service. Managing difficult employees, credibility determinations, and advanced interviewing are just a few of the in-depth topics covered. The program is geared toward fire officers, HR professionals with responsibility for fire departments, attorneys, and experienced union representatives who routinely advise members during an internal investigation.


The course builds upon Managing Disciplinary Challenges in the Fire Service, going deeper into interviewing; identifying and managing deception; evidence collection and handling; due process; Weingarten; Garrity and a firefighter’s right to remain silent are thoroughly covered along with the impact of civil service, collective bargaining, and firefighter bill of rights laws.
