Texas Food Truck Rule Proposal Raises Jurisdiction Questions

Texas lawmakers passed HB 2844 – the Mobile Food Vendor Freedom Act to create a statewide licensing system for mobile food vendors administered by the Texas Department of State Health Services (DSHS). The law is intended to eliminate the patchwork of local permitting requirements by establishing one statewide license and inspection framework.

To implement the law, DSHS is proposing new rules for mobile food vendors, including provisions addressing propane systems used on food trucks. The proposal references national safety standards including NFPA 58 (Liquefied Petroleum Gas Code) and NFPA 96 (Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations).

TPGA members have also raised concerns about proposed language describing systems as “readily moveable,” noting that the terminology may create confusion when applied to LP-Gas installations that fall under existing propane safety rules.

The TPGA Technical & Standards Committee discussed the proposal last week and emphasized that propane system oversight should remain with the Railroad Commission of Texas, the current authority having jurisdiction for LP-Gas. The Railroad Commission indicated it will work with its legal department to submit comments asserting its jurisdiction. Meanwhile, NFPA is developing a stand-alone code for mobile food vehicles, and Chapter 16 of NFPA 58 has been moved to the annex for the upcoming 2028 edition as part of that transition.

RRC Emailed Inspection Reports Available to TPGA Members

As a TPGA member benefit, the Railroad Commission of Texas provides participating TPGA member companies with expedited inspection reports by email. This courtesy service allows propane marketers to receive inspection results quickly and address any compliance items without delay. Reports are often received the same day, and at the latest within the week.

Important:

Only one primary contact per company may receive the emailed inspection reports.

Congress Advances Act to
Repeal Inflation Reduction Act
Home Electrification Programs

The U.S. House of Representatives recently passed H.R. 4758, the Homeowner Energy Freedom Act, in a 210–199 vote. The measure targets several home‑electrification incentives created under the 2022 Inflation Reduction Act (IRA) and would eliminate certain federally funded rebate and grant programs.

Introduced by Representatives Craig Goldman, Jake Ellzey, and Dan Crenshaw, all from Texas, the bill rolls back three IRA provisions and cancels any remaining unspent funds tied to two of them:

High‑Efficiency Electric Home Rebate Program ($4.275 billion): Provided point‑of‑sale rebates for low‑ and moderate‑income households to install electric appliances, including heat pumps with rebates up to $8,000.
State-Based Home Energy Efficiency Contractor Training Grants ($200 million): Supported training programs for contractors installing energy‑efficient equipment; most unused funds were already rescinded in earlier legislation.
Building energy code adoption grants ($1 billion): Helped states and local governments transition to updated energy codes such as the latest IECC or advanced “zero‑energy” standards.

The House vote on H.R. 4758 follows its approval of H.R. 4626, a separate bill aimed at limiting the Department of Energy’s ability to impose certain efficiency standards.

The legislation now moves to the Senate, where it would need 60 votes to advance.

NPGA Advocates for Energy Assistance Funding at LIHEAP Action Day

The National Propane Gas Association’s federal legislative staff joined their coalition partners, led by the National Energy Utility & Affordability Coalition (NEUAC), to participate in LIHEAP Action Day. The Low-Income Home Energy Assistance Program (LIHEAP) has been one of NPGA’s top legislative priorities this year after advocating for it at Propane Days. NEUAC’s members met with congressional offices from across the nation on Capitol Hill on February 25, 2026. On the day before, participants heard from Senators Jack Reed (D-RI) and Lisa Murkowski (R-AK), two congressional champions of the LIHEAP program.

NEUAC also organized a bipartisan panel of congressional staffers to discuss the program and what action needs to be taken in the future. NPGA will continue to work with NEUAC and other coalition partners in advocating for the success of the LIHEAP program.
