Last month's newsletter provided information regarding some of President Trump's EO's; how they may impact private sector employers, including those who are not federal contractors; and at least two court rulings. Since then, another court has chimed in, and 16 states AGs have issued guidance for private sector employers on DEI.

U.S. DOL Issues FMLA Opinion Letter


On January 14th, the U.S. Department of Labor issued an opinion letter clarifying how employers should administer federal Family and Medical Leave Act concurrently with a state paid leave program, and the employer’s own paid leave (sick, vacation, PTO).

On February 4th a Texas District Court judge denied an employer’s request for summary judgement on a Pregnancy Discrimination Claim. The employer fired its HR Business Partner six months after she disclosed her pregnancy. The employer produced documentation backing up their claim that the employee was fired for unsatisfactory work performance. So, what’s the problem?

NLRB GC Rescinds 30+ Memos


On Valentine’s Day, the National Labor Relations Board’s new Acting General Counsel rescinded more than 30 Memos issued under the previous administration. Of those, 13 are rescinded pending further review.

GovCon Take Note: FAR Council Withdraws Pay Transparency Rule


On January 8, 2025, four federal agencies (DoD, GSA, NASA, and the Office of Federal Procurement Policy) published notice in the Federal Register that they were withdrawing the proposed rule to amend the Federal Acquisition Regulation (FAR) titled: Pay Equity and Transparency in Federal Contracting.
