Fighting to Protect BRIM Coverage

Over the past several weeks, our members have been hard at work pushing back against HB 2015, a bill that would extend the moratorium on new or additional BRIM insurance coverage for volunteer fire departments, EMS agencies, local governments, and nonprofits. This legislation would also give BRIM the authority to non-renew current coverage for these critical entities—putting public safety and essential services at risk across West Virginia.

We’re incredibly proud of and grateful for the many members who have stepped up—making calls, sending emails, submitting public comments, and even visiting the Capitol to meet directly with legislators. Your advocacy is making a difference and showing lawmakers just how vital BRIM coverage is to our communities.

This fight isn’t over yet, but thanks to your continued efforts, our voice is being heard loud and clear under the dome.

Also, in relation to BRIM, HB 3516 was introduced in House Judiciary last week, which will amend the limit of liability insurance provided through the Board of Risk Management, the time period within which suits must be filed and will immunize state employees from personal liability except for orders of restitution by a court following conviction of a crime. This legislation provides: If any person to whom the right accrues to bring any personal action, suit, or scire facias, or any bill to repeal a grant, shall be, at the time the same accrues, an infant or insane, the same may be brought within the like number of years after his or her becoming of full age or sane that is allowed to a person having no such impediment to bring the same after the right accrues, or after such acknowledgement as is mentioned in S55-2-8 of this code, except that it shall in no case be brought after 20 years from the time when the right accrues. This bill passed out of committee and is on 2nd reading in the House.

Another piece of legislation, HB 3513 will establish standards of liability and insurance requirements in certain civil actions originated last week in House Judiciary. The Big I has worked on this liability legislation for the past year in an effort to be able to serve our clients. This legislation has passed out of House Judiciary and is on first reading on the House Floor.

In addition to these bills, we are also watching many other bills on behalf of the Big I. For a full list, click here.

From the President

Dear Members,

As we step into spring, I want to take a moment to say how incredibly proud I am of our Big I WV members. This legislative session has not been easy, and House Bill 2015 – the proposed extension of the BRIM moratorium – has demanded our full attention. While the future of the bill remains uncertain, one thing is crystal clear: you have shown up.

Whether it’s been a phone call, an email, or walking the halls of the Capitol to talk face-to-face with legislators, your voices have been heard. The unity and passion you’ve demonstrated in standing up for independent agents and our clients across West Virginia is exactly what makes Big I so special. We aren’t just colleagues; we’re a community that looks out for each other, for our businesses, and for the people who depend on us every day.

And while the fight on HB 2015 continues, rest assured that we are not backing down. We’ll keep pressing forward, together, until the job is done.

As the seasons change, it’s also a great time to remind your clients about their insurance needs. Spring is often a time of renewal – people are moving, making home improvements, buying recreational vehicles, and preparing for summer travel. It’s a smart time to review policies, ensure proper coverage, and check in on any life changes that could impact protection. These moments matter. It’s when we get to show our clients why independent agents are invaluable.

I also hope you’re planning to join us in Washington, D.C. this May for the Big I Legislative Conference, which will be held April 30 – May 2. It’s a powerful opportunity to connect with national leaders, advocate for our industry, and continue the work we’ve started here at home. Plus, it’s always a great time to catch up with friends and fellow agents from across the country.

Thank you again for your commitment, your action, and your heart. Let’s carry this momentum through the spring and beyond.

Sincerely,

Suzette Raines Ashley

President
