The US Department of labor has published a new WH-347. It provides a lot more detail on how wages and fringe benefits are paid.

Conformances under the CHIPS Act



Most of you are likely familiar with the conformance process the US Department of Labor (DOL) uses to approve wage classifications missing from a particular wage determination. The “contracting officer”, from the agency overseeing the project, is the appropriate party to submit that conformance request. More recently, when certain tax credits are being provided and no direct funding, the DOL allows the owner of the property (when there is no “contracting officer”) to submit the request directly to the DOL. However, for anyone performing work under the CHIPS Act, the DOL is requiring someone from the CHIPS Program Office sign as the Contracting Officer. So, please confirm your funding source and who would be identified as a Contracting Officer or another Representative to sign these conformances.


TIP: CCMI always includes a cover letter describing the project in more detail, a detailed scope of work and any back up documentation from where the proposed wages were derived.

QUESTION:

I thought prevailing wage was tied to publicly funded construction. Recently I have seen prevailing wages imposed on projects where there is no direct public funding. Why is that?

ANSWER: 


Most recently the Inflation Reduction Act and the CHIPS Act imposes prevailing wages (and IRA has mandated apprenticeship requirements). In those instances, some type of tax credit or other financial incentive is deemed to be the “federal assistance” triggering the prevailing wage requirements. Other State use other triggering events to claim “state assistance” triggering state prevailing wage requirements. For example: In California, a private party purchasing public land for less than “market value” will trigger California prevailing wages for the first generation of construction on that land. In other instances, getting a housing project approved through an expedited approval process (SB35) triggers California prevailing wages.
