May 25, 2023: The 2023 Orphan Fund Levy has been set for $10,000,000 and invoices were issued on May 31, 2023 through IRIS. Please note: you will not receive a follow up invoice by mail.
Please be advised that in accordance with the Financial Security and Site Closure Regulations, the orphan levy due date changed from 30 to 60 days. The payment must be submitted within 60 days of the invoice being issued.

BC: New Seismic Dataset to Support Restoration
|
On May 9, 2023, the BCER published the new enhanced 2D legacy seismic data with ecological information on the BCER Data Centre. This information is designed to facilitate an understanding of the location and characteristics of seismic cutlines and support restoration planning initiatives in the northeast. The dataset also includes additional attributes like biogeoclimatic data, elevation, adjacent forest cover, soil information, wetlands, caribou ranges and forest fire data to support restoration planning.

BC: Reclamation Guidance for the Use of Ecologically Suitable Species
|
On May 11, 2023, the BCER published the revised restoration and reclamation guideline. The guideline is intended to introduce expectations for meeting the intent of section 19 of the Environmental Protection Management Regulation (EPMR) as part of the Certificate of Restoration (COR) Part 2 application process. It provides the oil and gas sector reclamation guidance related to planning, implementing, and performance reporting of soil and vegetation metrics for Crown forested land in northeast BC.

BC: Changes to the Permittee Capability Assessment (PCA) Program
|
Under the PCA program, permit holders assessed with moderate or high levels of financial risk must complete corrective action requirements through the submission of security deposits and/or the completion of work to reduce their “DIM” liability; that is, abandonment, assessment, remediation and/or restoration work on their Dormant, Inactive and Marginal (DIM) sites. The amount of corrective action required is scaled in relation to the level of a permit holder’s financial risk.
As of June 1, 2023. the BCER reduced the risk factor to a more conservative value of 66.6 (i.e., now companies with an assessed risk factor over 66.6 are required to take 100 per cent corrective action against their DIM liability) and discontinued the provisional 50 per cent annual limit.
Also, effective June 1, 2023, permit holders with DIM Liability equal to or more than $1 million must now include audited financial statements with their annual financial eSubmission, prepared in accordance with International Financial Reporting Standards or Canadian accounting standards for private enterprises.

BC: New Security Management Regulations
|
The Security Management Regulation (B.C. Reg. 181/2022) came into effect on June 1, 2023. The objective of the Security Management Regulation is to ensure energy companies have appropriate measures in place to identify and minimize security risks to infrastructure, which could jeopardize the province’s safe, secure, and reliable energy supply. It applies to all oil and gas activity permit holders under the BCER.
