EEOC & DOJ Issue Guidance on DEI Discrimination


On March 19th, the U.S. Equal Employment Opportunity Commission (EEOC) and the U.S. Department of Justice (DOJ) announced the release of two technical assistance documents focused on educating the public about unlawful discrimination related to “diversity, equity, and inclusion” (DEI) in the workplace.

April Fools – It’s No Joke – Lack of Workplace Civility May Lead to Civil Litigation


It was no joke on April 1st when an employer agreed to pay one employee $20,000 to settle a claim of religious harassment. The lawsuit alleged a Muslim, teenage employee was harassed, retaliated against, and forced to quit after a manager forcibly removed her Hijab.

Oh, My Aching Feet! An ADA Lawsuit?


An employer required its cocktail servers to wear black high heels as part of their uniform. One server provided a doctor's note that explained the employee had “Equinus Deformity” and “Achillis Tendinitis,” should “avoid heels” and “wear good supportive shoes” to aid her in performing her job duties. The employer granted the request for the employee to “wear flats/good support shoes instead of heels.” So, what’s the problem?

Diversity Policy Lands Employer in Hot Water - and Court!



On March 26th a U.S. District Court judge denied an employer’s motion to dismiss a lawsuit. The suit was filed by a former employee claiming the employer’s diversity policy and related practices discriminated against him based on his sex and race.

US CIS Announces "Minor Changes" to Form I-9 and E-Verify


On April 2, 2025, the U.S. Citizenship and Immigration Services announced publication of “minor changes” to the Form I-9. Employers may continue to use the “old” forms.

EEOC Files for Non-Substantive Changes to EEO-1 Form & Instructions


On April 15th, the EEOC filed with the federal Office of Management and Budget notice of its intent to modify the EEO-1 instructions. One is to “remove [the] response option for voluntary reporting of “non-binary” employees.
