Key Updates from the Alternative Fuel Safety Division of the Railroad Commission

The Texas Propane Gas Association (TPGA) hosted its Q2 2025 Board and Committee Meetings in Austin and invited the Alternative Fuels Safety (AFS) Division of the Railroad Commission of Texas to provide an update.


AFS Director Karley Rudynski, Compliance and Licensing Supervisor Angie Whitehead, and April Richardson were in attendance.


Here are the key takeaways we wanted to share with members:

Transitioning Portal System:

  • RRC confirmed temporary delays expected during platform migration at the end of June. AFOS portal to be down a week.


Form 4 Decals:

  • Decals can be FedEx’d (if needed urgently).
  • In-person pickup is available (if requested).
  • Some terminals reject RRC letters; decals must be on truck.
  • Karley’s team can contact the terminal on the company’s behalf if needed.


Communicating with RRC:

  • Preferred method = email
  • New e-fax numbers available

- New compliance fax: 512-682-9066 - New licensing fax: 512-828-8790

Common Paperwork Processing Delays:

  • Common hold-ups: Missing hydro tests, Secretary of State docs, franchise tax info.
  • Encourage timely tester submissions and updated employee certifications.

TPGA Q2 Roundup: Legislative Wins, Legal Fights, and Industry Issues

In addition to the Railroad Commission presentation, TPGA hosted several important committee meetings during its Q2 2025 Board & Committee Meetings in Austin, drawing more than 70 members from across the state for the two-day event.


Scholarship Report

  • Scholarship Board approved $28,000 in awards for the 2025 school year.


New Staff Member

  • Introduction of Christy Shook, TPGA’s newest staff member managing meetings, membership, and PSC.


Legislative Update

  • TPGA Legislative Committee Chairs gave an update on our top bills we are tracking, as the 89th Texas Legislative Session comes to a close on June 2nd.


Legal & Regulatory Affairs

Legal Update: Houston Lawsuit

  • TPGA is scheduled to return to court in July.
  • The City of Houston is challenging the constitutionality of the TPGA-backed law.
  • Attorney General Ken Paxton may join the case to defend the law.
  • TPGA legal counsel remains confident in a favorable outcome.


Temperature Compensation for Dispensers

  • The National Institute of Standards and Technology (NIST)mandates that all new LP-Gas dispensers be temperature compensated by 2026; existing dispensers must comply by 2030.
  • NPGA’s current proposal is a voting item on the NCWM Annual Meeting agenda.
  • A joint proposal from NPGA and NIST (presented this week) seeks to extend the retroactivity deadline to 2034, giving the industry 10 years from adoption.
  • Applies to dispensers rated at 20 GPM or less—typical for retail cylinder filling.
  • Only electronic temperature compensation can meet the requirement.
  • Estimated cost: $3,000–$4,000 per dispenser.


Texas Department of Agriculture Resolution

  • Commissioner Sid Miller has verbally approved the continued use of fixed-price sales for 20 lb propane cylinders.
  • TPGA is currently seeking formal written confirmation of the resolution.


FMCSA English Proficiency Enforcement

The FMCSA is now actively enforcing long-standing English language rules for interstate commercial drivers.


Drivers must be able to read and speak English to:

• Converse with the public

• Understand road signs and signals

• Respond to official inquiries

• Complete reports and records

New enforcement includes interviews and highway sign recognition tests.

Drivers who fail the language assessment will be placed out of service immediately.


This enforcement follows a recent Executive Order and is effective immediately.


Oklahoma-Texas Expo Collaboration

  • The Executive Director of the Oklahoma LP-Gas Board proposed an informal invitation for Oklahoma marketers and exhibitors to attend the 2026 TPGA Expo in Irving, TX.
