Paycheck Protection Program - Revision Highlights

  • The loan term has been extended to five years for all new loans. Existing loans can retain their two-year term, though the bill expressly gives lenders and borrowers the right to negotiate a longer term if they both agree.

  • Revising the 75/25 payroll requirement to a 60/40 threshold. This enables the business owner to use more of the funds towards other operating expenses such as rent.

  • Extending deferrals to the point the forgiveness amount is remitted to the lender or 10 months after the end of the covered period.

  • Lengthening the eight-week period during which to use the funds to 24 weeks. It also allows borrowers to elect to use the original eight-week period.

  • Expanding the exemptions related to reduction of employees based on employee availability. The forgiveness amount will not be affected by a reduction in employees if the borrower is able to document an inability to rehire individuals, to hire similarly qualified employees, or to return to the same level of business activity as it was operating at before February 15, 2020.

  •  Allowing borrowers with forgiven loans to potentially defer payroll taxes.
