The Transportation Security Administration (TSA) proposed a new rule.
While still in review, the preliminary assessment finds TSA considering whether to apply security checks on employees of all over-the-road bus companies (including charter) to include:
- Security-sensitive employees of certain public transportation operators and railroads to undergo a Level 2 security threat assessment (STA) that includes an immigration check and terrorism watchlist check;
- Security coordinators to undergo Level 3 Security Threat Assessment (STA) includes an immigration check which includes the Level 2 check plus a criminal history records check.
TSA is following recommendations of the 9/11 Commission Act of 2007 (9/11 Act) that require security vetting of certain public transportation, railroad, and over-the-road-bus (OTRB) employees and to establish user fees to recover TSA's costs for vetting.
The agency is considering comments before or on August 21, 2023.
