Overtime Salary Threshold

The US Department of Labor (USDOL) updated the exempt/overtime salary threshold from the current ($17.10/hour, $684/week, $35,568/year) to ($21.10/hour, $844/week, $43,888 annual), effective July 1, 2024. If your employee earns less than $21.10 per hour, they will be entitled to overtime pay of 1.5 times their normal for all hours over 40 per week after July 1, 2024, in most cases. An additional increase is set for January 1, 2025, and annual increases are scheduled thereafter. But, the rule has been challenged in federal court by coalition groups seeking an injunction.

Under the Hood Exemption Extension Comment Deadline

The Federal Motor Carrier Safety Administration (FMCSA) is accepting comments until July 1, 2024, about the pending proposal to extend the current Under the Hood Exemption CDL Testing Exemption (School Bus Only CDL). In the past 24 months, more than 600 CDL applicants in 12 states have obtained their School Bus Only CDL, providing drivers for approximately 42,000 students. The current Under the Hood CDL Testing Exemption (School Bus Only CDL) is set to expire November 27, 2024, unless extended. FMCSA’s public comment period for the extension application remains open through July 1, 2024. Please follow these directions in order to submit your comments online:

1. Go to www.regulations.gov and put the docket number (‘‘FMCSA–2022–0148’’) in the ‘‘Keyword’’ box and click ‘‘Search.’’

2. When the new screen appears, click on the ‘‘Comment Now!’’ button and type your comment into the text box in the following screen.

3. Choose whether you are submitting your comment as an individual or on behalf of a third party and then submit.
