County Jail Daily Rate for Housing Municipal Inmates- Senate Bill 2432

County jails across Mississippi routinely house municipal prisoners arrested by city law enforcement. For many years, counties and municipalities have worked together through locally negotiated agreements to ensure counties can continue accommodating municipal inmates while managing the operational and financial demands placed on county jail systems.


Following a recent Attorney General’s opinion interpreting state law to limit municipal payments to $25 per day, counties have expressed concerns that the current rate does not reflect the actual cost of housing inmates.



Legislation addressing this issue is currently being considered through Senate Bill 2432.

The bill has now advanced through both chambers and will move to a conference committee. During the conference process, the House and Senate each appoint three conferees to negotiate the final language of the bill. For a conference report to be adopted, at least two of the three conferees from each chamber must sign the conference report before it can be presented to both the House and Senate for final consideration.

To assist in these discussions, MAS is asking counties to provide input on the minimum per-day amount their county would need in order to continue accepting municipal inmates if the Legislature establishes a statutory cap, along with any additional information counties believe would be helpful for policymakers to understand.


Because conference negotiations may move quickly, timely responses from counties will help ensure MAS can provide lawmakers with accurate county data during these discussions.
