Bus Association of New York fends off inspection tax
Congratulations are in order! Last week the Bus Association of New York (BANY) scored an important victory, defeating an onerous proposed inspection tax on passenger carriers. The New York State Department of Transportation inspects passenger carrier vehicles twice a year under their “721” program, which has been in place for decades. However, when New York Governor Andrew Cuomo proposed charging $120 per inspection and legislation was introduced in the Assembly and Senate, BANY members sprang into action with a powerful letter writing and phone campaign. And they prevailed.

“BANY members have been relentless for the last eight weeks contacting their legislators via letter writing campaigns and personal phone calls to lobby against the provision in the governor's proposed budget,” said current BANY president Cam Morris, manager of Hale Transportation in Oneonta. When commenting on the victory she said, “It was all of us!”

This is the second time BANY has defeated an onerous tax targeted at the bus industry. A few years ago, the state of New York attempted to impose a retroactive sales tax on fares and charters.

It's here: ELD enforcement started April 1
The Commercial Vehicle Safety Alliance alerted commercial motor vehicle (CMV) enforcement officials to begin full enforcement of the ELD regulation that began this past Sunday, April 1, 2018.

Passenger-carrying CMV drivers operating their vehicle without a required registered electronic logging device (ELD) or a grandfathered automatic on-board recording device (AOBRD) will be placed out of service for eight hours.

Violations will be recorded on the inspection report and the driver may be cited (e.g., issued a violation ticket or a civil penalty) for failing to have a required electronic record of duty status. All ELD violations will be counted against a motor carrier’s Safety Measurement System (SMS) score, which could result in selection for an investigation within the Federal Motor Carrier Safety Administration’s (FMCSA) Compliance, Safety, Accountability (CSA) program. FMCSA will determine the appropriate action against non-compliant motor carriers.

After eight hours out of service, the driver may continue to their final destination, provided the driver has accurately documented their hours-of-service requirements using a paper record of duty status (e.g., log book, daily log or log) and has a copy of the inspection report and/or citation.
