Important Board of Pharmacy Update
DEA Makes Changes to Schedule II Controlled Substances Prescribing

During a telephone discussion between DEA and NACDS, DEA indicated that, despite historical guidance permitting pharmacists to make annotations to Schedule II Controlled Substance prescriptions, Schedule II Controlled Substance prescriptions must now arrive at the pharmacy with the elements required by 21 C.F.R. 1306.05(a) to be valid. The DEA has made no public statement regarding this policy change.

What you need to know:
  • 21 C.F.R 1306.05(a) requires that all prescriptions for controlled substances shall be dated as of, and signed on, the day when issued and shall bear the full name and address of the patient, the drug name, strength, dosage form, quantity prescribed, directions for use, and the name, address and registration number of the practitioner.
  • A paper prescription must be manually signed (wet signature) by the practitioner and a computer-generated prescriptions that is printed out by the practitioner must also be manually signed.

What does this mean?
  • If any of the elements of a prescription required by 21 C.F.R 1306.05(a) are missing or in need of alteration (such as the address of the patient) then the pharmacist CANNOT add or change any of the elements, and the prescriber must instead issue a new prescription. The patient will need a new prescription from the prescriber or the prescriber may send an electronic prescription
  • While many state regulations, policies or guidance documents may currently allow a pharmacist to add or change certain elements of a controlled substance prescription, this reported policy change from the DEA becomes the stricter of federal versus state laws. It’s important to note, that some state boards of pharmacies are aware of this policy change and are now enforcing the stricter standard too. As always, the stricter standard must be followed.

While the DEA is currently reviewing the relevant regulations found under 21 C.F.R Part 1300 and working to draft regulations to address what, if any, information a pharmacist can add or change on controlled substance prescriptions practitioners should make sure that the required elements are present on prescriptions that they issue to minimize interruptions to patient care.
