A Message from the State Attorney

Dear Friend,

The holiday season is upon us and many of us are getting ready to gather with family, loved ones and friends. This year will have a very special significance because of everything we have experienced during the pandemic.

At this time of year, as we celebrated the Thanksgiving holiday, I make it a point to reflect on the past 12 months and truly appreciate the many blessings and opportunities I have received both personally and professionally.

I am overwhelmed as I review the accomplishments that we, as your State Attorney’s Office, have been able to achieve especially under the extraordinary circumstances and challenges we have faced together.

As prosecutors, we see some of the most tragic and heartbreaking situations one could ever imagine. Yet we also witness how human beings in those circumstances can inspire us through their courage, resilience, and generosity.

Though we often focus on the things that aren’t working out as we would like them to, it is just as important to look at all the things that are working. This helps give us hope and momentum to continue making a difference.

I want to thank you for allowing me to share our work with you through this newsletter. It is because of your support and partnership that we have been able to implement innovative and efficient Smart Justice programs and make our community a safer place to live, work and raise our families.

Major County Prosecutors Council
State Attorney Katherine Fernandez Rundle and Chief Assistant Stephen K. Talpins participated in the Association of Prosecuting Attorneys’ Major County Prosecutors Council in New York.

The two-day conference included a diverse group of District and State Attorneys and criminologists and focused on topics such as Criminal Court Initiatives; Diversity, Inclusion and Employee Wellness; Transparency and Public Dashboards; Police Integrity and Accountability; Crime Strategies Units and Community Partnerships; and Cybercrimes and Identity Theft.

State Attorney Fernandez Rundle joined a panel composed of members of the New York County District Attorney’s Office and East Baton Rouge District Attorney’s Office for an important conversation on Police Integrity and Accountability.

During a meeting of the Florida Prosecuting Attorneys Association (FPAA), State Attorney Katherine Fernandez Rundle joined State Attorneys from across Florida to discuss legislative priorities and securing additional resources to advance Smart Justice and continue keeping Miami Dade County and the rest of Florida safe. Breaking the Silence:
Keeping Kids Safe from Online Predators

This year’s Kristi House Breaking the Silence Luncheon, presented by Nicklaus Children's Hospital, was a hybrid event that featured a panel on the all-important, timely topic of “Keeping Kids Safe from Online Predators".

“I am very proud to have been part of this esteemed group of panelists and colleagues to talk about the importance of keeping our children safe from online predatory behavior,” said State Attorney Katherine Fernandez Rundle. "Because even a single cybercrime against a single child is unacceptable."

The panel included Superintendent Alberto Carvalho (Miami-Dade County Public Schools), FBI Special Agent Alex Loff (Child Exploitation and Human Trafficking Task Force), and Titania Jordan (Chief Parent Officer of parental-control app Bark - Parental Controls, co-author of “Parenting in a Tech World”).

Courtroom Highlights

•       Congratulations to ASAs Leonard Thompson and Nicole Garcia for obtaining guilty verdicts on charges of Kidnapping (LIFE), Sexual Battery by Multiple Perpetrators, and Simple Battery. The Defendant kidnapped the Victim and took her to a music studio where she was sexually battered by several men. He then discarded the victim at a random location where she was located the next morning thanks to a 911 call. The jury deliberated for 10 hours before returning the guilty verdicts.

Special thanks to Samantha Mesa, Maria Diaz, Idalvis Trujillo and April McClellan for their tireless efforts. Thanks to all of the support staff who served as mock jurors in the preparation of this case.
 
•       Congratulations to DC Khalil Madani and STC Michael Von Zamft for securing a guilty verdict of First-Degree Murder and Conspiracy to Commit First-Degree Murder on a 2003 homicide. The Defendant and an accomplice were hired by the Victim’s wife to murder her husband for the insurance proceeds. The Defendant walked up to and shot the Victim in the back of the head and staged it to look like a robbery gone wrong. From 2003-2009, investigators did not have many leads as the wife of the victim was inside her house at the time of the murder and there was no physical evidence tying Javon Robinson to the crime scene.

Finally, in 2009, an accomplice who was in jail on another matter came forward and confessed his involvement in the case and provided information allowing the investigators to identify the shooter. After being arrested the Defendant gave a lengthy confession to the murder. At trial, the defense attempted to argue that the accomplice’s testimony could not be believed, and that the Defendant’s confession was a product of coercive police tactics. The jury deliberated for one hour and twenty minutes before returning a verdict of guilty as to both counts in the indictment.

•       Congratulations to ASA Deanna Andrews and ASA Alex Bergida on securing a guilty verdict in a case involving battery on a law enforcement, resisting without violence, and disorderly conduct. Special thanks to Trial Coordinator Brittney Grant, Victim/Witness Counselor Katherine Garcia, and Litigation Support for their invaluable assistance.
 
•       Congratulations to ASAs Stephen Mitchell and Joseph-Robert Forman, who obtained guilty verdicts for Armed Burglary, Armed Kidnapping, Armed Carjacking, Armed Robbery and Aggravated Assault. The Defendant, a prison release reoffender who had armed and masked himself, dragged the Victim inside his home to rob him. The Victim’s wife and two young children were also inside the residence. After robbing the Victim inside his home, he then kidnapped him and forced him at gunpoint to drive to and withdraw money at an ATM. They drove back to the residence and the Defendant subsequently stole the Victim’s car.
 
Special thanks to Evika Jones, Mar Rodriguez, Mary Ann Miyskiw-Jones and Eric Torres for their efforts in coordinating the travel arrangement for three out of state witnesses and additional assistance throughout the trial.
 
·       Congratulations to ASAs Alex Bergida and Ana Cuello on receiving guilty verdicts of Tampering with a Victim, False Imprisonment, and Battery. A very special thanks to Roxanne Hubbard and Alexa Perdomo for their assistance with the witnesses.
 
·       Congratulations to ASAs Ramy Simpson and Adianez “Adi” Jimenez for obtaining a guilty verdict of Aggravated Battery Resulting in Great Bodily Harm with an Enhancement for Use of a Weapon. ASA Jimenez previously litigated the Stand Your Ground immunity claim before the pandemic.
 
On March 4, 2017, the Victim, Defendant, and Co-Defendant were in a strip club when they got into a heated argument where the Victim slapped the Co-Defendant. The parties were separated by security and the codefendants were escorted out to the parking lot. A few minutes later, the Defendant (armed with a knife) and Co-Defendant (now armed with a long, metal pipe) ran between the parked cars toward the Victim from two directions. The Defendant stabbed the Victim in the back twice with a knife as he ran away.   
 
Special thanks to Cary Jose and Winston Bennett for all their help with the requests and the witnesses. Thanks to our Litigation Support team for all their help with demonstratives and video equipment that allowed ASAs to show CCTV footage on one monitor and the Defendant’s Stand Your Ground recorded testimony on another.


·       Congratulations to ASAs Katharine Moore and Justus Hogge for obtaining guilty verdicts/a plea against four Co-Defendants for Armed Robbery with a Firearm, Conspiracy to Commit Armed Robbery with a Firearm, and Convicted Felons in Possession of a Firearm.

One of the Defendants texted his friends that his co-worker had received a large sum of cash earlier that day. Video footage showed a vehicle parked in front of the Victim’s job for more than 20 minutes. When the Victim walked out, two gunmen exited the vehicle and demanded his wallet.

Less than five minutes after the robbery, an officer immediately pulled over a vehicle matching the B.O.L.O. Body worn camera footage of this was valuable evidence along with the recovery of two firearms and video evidence of the actual crime. Three of four co-defendants were found guilty after jury trials, and sentenced to, or will be sentenced to, mandatory life sentences as prison releasee reoffenders. The fourth co-defendant plead guilty and was sentenced to 20 years in state prison followed by 10 years of reporting probation as a Habitual Violent Offender.

·       Congratulations to ASAs Leonard Thompson and Vianca Picart who secured a guilty verdict for Domestic Violence charges including False Imprisonment, two counts of Sexual Battery, two counts of Simple Battery, and Tampering with a Victim.
 
The Defendant was jealous after he learned that the Victim had kissed another man and that the Victim wanted to end the relationship. The Defendant held the Victim against her will for 48 hours. She finally was able to ask a neighbor to call 911 when the Defendant left for a beer run. This case largely relied upon the credibility of the victim.
 
Special thanks to Victim Witness Counselors Samantha Mesa and Rayna Milfort during the trial. Samantha Mesa went above and beyond in getting the victim travel accommodates and supporting her through the trial. 
Kozyak Minority Mentoring Foundation
"Virtual Conversation with Government Lawyers"
State Attorney Katherine Fernandez Rundle, alongside Public Defender Carlos J. Martínez and James Alan Weinkle from the U.S. Attorney's Office for the Southern District of Florida, participated in a ‘Virtual Conversation with Government Lawyers’ hosted by the Kozyak Minority Mentoring Foundation during which they explored different areas to help first and second-year law students navigate the path towards their desired careers.

"Saving Our Youth Symposium"

State Attorney Katherine Fernandez Rundle joined an elite group of panelists for the “U-Turn Youth Consulting 2021 Saving Our Youth Symposium” (SOYS) held at St. Thomas University.

The State Attorney spoke on one of her ground-breaking innovations that divert people from the traditional criminal justice system, Civil Citations in lieu of incarceration.

Dr. Shirley Plantin, Chief Executive Consultant at U-Turn Youth Consulting, hosted the event highlighting this year’s theme “Our Systems”. 

U-Turn Consulting is an education, training, and advocacy firm that specializes in urban youth conflict/resolution by advocating for changes that benefit at-risk youth, their families, and communities.
SAO Victim Witness Services Unit and Human Trafficking Division Honored
State Attorney Katherine Fernandez Rundle was proud to join with the Survivors’ Pathway Organization, in partnership with the City of Miami Police Department and the Domestic Violence and Sexual Assault Council of Greater Miami, for an event at which SAO team members from our Victim Witness Services Unit were recognized for their compassionate response to the Surfside victims and families during the aftermath of the Champlain Towers South Condominium collapse.

“As a community and as a nation, we were shocked by the collapse of the Champlain Towers South Condominium. We have never seen anything like this. I am beyond proud of the members of my Special Victim Advocates Unit and SAO Crisis Response Team who quickly answered the call to help survivors and the families devastated by this disaster,” said State Attorney Fernandez Rundle.
“I could not be prouder of these dedicated individuals, their efforts and their selfless service to our community. I truly appreciate this recognition by Survivor’s Pathway of their efforts, which have not waivered since the tragedy, as they continue to work with and for the victims today.”

Also recognized at the event was the SAO's Human Trafficking Division for their leadership, service, commitment and life-changing efforts to empower survivors of crime.

Survivors Pathway provides needed support to survivors of domestic and intimate partner violence, sexual abuse, human trafficking, and multiple types of victimization.
SAO & CABA Holiday Toy Drive

I am thrilled to announce that we have partnered again this year with the incredibly supportive and generous Cuban American Bar Association (CABA) to collect and distribute hundreds of toys to needy and victimized children in our Miami-Dade County community.
 
We have set up collection boxes in the lobbies of our different SAO office sites to gather toys for children victims of the State Attorney’s Office.
 
Please help us put a smile on the face of children who otherwise would not have a present to open during the holidays. Children who may have suffered a traumatic experience involving gun violence, sexual assault or domestic violence and so many other crimes will appreciate these gifts of love. We will be accepting all types of contributions through December 9th. I am happy to inform you that our friends at Crime Stoppers have pledged a total of $500.00 in gift cards. Toys must be new and unwrapped.
 
Of all the things available during this holiday season, the gift of kindness and hope is often the one that can do the most good. If a small present lights up a child victim’s eyes and brings a smile to a parent, then we have done additional good and lessened the weight that trouble and misfortune always carry with it.
 
Let’s fill these boxes as much as we can and make 2021 the best holiday season ever for our precious children!
Community Outreach in Action
Our Community Outreach Representative Janeen Jones along with SAO volunteers Roxanne Hubbard and Natavia Davis, in partnership with Miami Children's Initiative (MCI) and former NFL player
Bryant Mckinney participated in "Operation Turkey" Miami" at the Joseph Caleb Center.

On Thanksgiving Day, they distributed over 1,000 meals throughout the community.

Community Outreach Representative Angie Fernandez attended the Cuban American Bar Association (CABA) Annual Elections & Toy Drive.

Our SAO table was filled with new and unwrapped toys for our office's children victims of crime thanks to the generosity to those in attendance.

Also at the event were ASAs Carolina Sanchez, Dianet Torrez, Brandon Gonzalez, Gabriel Pla and Blairr Miller.

Public Information Officer Zachary Rinkins participated in Camillus House's Thanksgiving event.

Volunteers were able to distribute hot meals and spread holiday cheer to some of our community's most vulnerable residents.

SAO partners with Camillus House to support Project Phoenix for survivors of Human Trafficking.

Our Community Outreach Representative Yeileen Jacome joined members of numerous law enforcement agencies, local leaders and residents from the municipalities of Surfside, Bal Harbour and Bay Harbor Islands for a joint "National Night Out" event.


Visit our Team and Justice in Motion (JIM) Bus at the Youth Fair

Our JIM Bus will be staffed by SAO team members who are available to assist visitors with any questions regarding our office's programs and services and community resources.

Community Outreach Representative Yeileen Jacome participated in the Law Enforcement Officers Memorial High School’s Parent Night.

She shared information on our various programs and the role of the SAO in law enforcement.

 Community Outreach Representative Janeen Jones participated in Bibles Up, Guns Down - Youth Crime Prevention Summit at Sherbondy Village Park in Opa-Locka.

Along with numerous community agencies, she provided information about the programs and services we offer.

Victim Specialists Uvonne Roundtree of our North Side Gun Violence Reduction Initiative and Inza Andrews of our Miami Gardens Gun Violence Reduction Initiative attended a Day of Remembrance for Murdered Victims sponsored by the RJT Foundation and City of Miami Gardens Mayor Rodney Harris to remember our community's victims who have been senselessly murdered.

Siblings of the victims spoke on behalf of their beloved fathers, mothers, brothers and sisters, and other family members who have lost their lives to gun violence in Miami-Dade County.


Public Information Officer Zachary Rinkins recently attended Florida Memorial University’s Social Justice Institute’s 'Different World - Reimagining the Future' forum.

Speakers included Florida Rights Restoration Coalition (FRRC) Executive Director and recent MacArthur Fellows Program recipient Desmond Meade.

State Attorney Katherine Fernandez Rundle collaborated with Mr. Meade to restore the rights of many returning citizens under the State Attorney’s Amendment 4 plan. 
Community Outreach Representative Angie Fernandez joined members of the Asian American Advisory Board, Taipei Economic and Cultural Office in Miami, and On Leong Merchant Association Miami Chapter;
South Florida Chapter President of OCA Winnie Tang; Village of
El Portal Mayor Omar C. Nickerson; a dear friend of State Attorney Katherine Fernandez Rundle’s father, Felipe Lee; and community residents for the Flag Rising Ceremony in celebration of the 110th
National Day of the Republic of China –Taiwan.
Outreach Representative Janeen Jones and Assistant Community Events Coordinator Steve Machin participated in The 16th Annual Campus Safety Day at Miami Dade College North Campus.

They shared information with students, faculty and staff about crime prevention and providing safety awareness tips, available resources and services to the community to reduce the odds of anyone becoming a victim of any type of crime.
