Commonwealth's Department of Family and Medical Leave Has Published a Workplace Poster and Notice Forms for Employees and Independent Contractors
As discussed during Mirick O'Connell's recent Annual Labor and Employment Seminar, employer obligations under the new Massachusetts Family and Medical Leave Law, M.G.L. c. 175M, commence soon. In particular, withholding obligations related to the trust fund established to fund leave under the new law begin July 1, 2019.  Prior to that date, the Department of Family and Medical Leave will publish its final regulations under the new law. 
 
In the interim, the Department has published a workplace Notice/Poster, which can be found here. The Notice/Poster must be posted in a conspicuous place at each of an employer's premises. The Notice/Poster must be in English and in any other primary language of five or more employees in the workplace. Employers must post such Notices no later than July 1, 2019.
 
In addition to posting the above-referenced Notice Poster, employers must provide a separate written notice to all employees and independent contractors, as applicable, no later than May 31, 2019.  Copies of the notices can be found here under the "Notifying your workforce" section of the Department's website.  As required by the current draft regulations published by the Department, each employee and independent contractor must sign an "Acknowledgment" on which they either acknowledge receipt of the applicable notice or indicate their refusal to sign the acknowledgment.  Copies of the signed notices/acknowledgments should be retained in each employee's personnel record (and a file for each independent contractor, as applicable).
