On August 19, Cole County Circuit Judge Daniel Green ruled in favor of Secretary of State Denny Hoskins and upheld Secretary Hoskins decision not to certify initiative petition 2026-106 (“the egregious IP reform petition”).
The Judge ruled that the IP violated the constitution in that it contains more than a single subject and affected more than one article of the Constitution, and that the IP, if passed, would be a radical alteration of Missouri’s government that would undermine the guarantee of a representative democracy form of government guaranteed under the United States Constitution. The plaintiffs have appealed this decision to the Western District Court of Appeals.
If passed the IP would prohibit the legislature from passing any form of IP reform and would severely limit, and as a practical matter probably prohibit, the legislature’s ability to place issues on the ballot for voters’ consideration. The broad and vague language of the IP would require 80% approval before the legislature could place any issue on a ballot that would either explicitly or by implication modify or undermine any provision of any Law or amendment that had been passed since 2010 by initiative petition. It would also place that 80% requirement on the legislature prohibiting them from placing any issue before the voters that is in any way similar to any other issue that had been rejected in an election since 2010.
The last several initiative petition amendments and laws that have passed have won in as few as 8 of Missouri’s 114 counties, with liberal out-of-state interest pouring over $30 million into media campaigns concentrated in the most populous areas of the state to mislead the voters on the real effect of the Constitutional Amendments.
If passed this IP would pave the way for liberal out of state millionaires to fund initiative petition campaigns with massive media efforts that will lie about the true effect of the initiative petitions and will eliminate the state legislature's ability to place issues on the ballot to correct those lies.
Missouri Right to Life PAC opposes this egregious reform initiative.
