Adding a Pre-Tax Transportation Fringe Benefit for your Staff and Temporary Employees?

Bills have been filed this month in the NJ State Legislature (S-1567/A-2425) which would require New Jersey employers with 20 or more employees to offer their employees access to a pre-tax transportation fringe benefit program. Essentially employees can purchase transportation and parking services with pre-tax income up to a maximum of $260 per month in 2018, saving both the employee and employer money on taxes. Employers do not have to pay FICA and unemployment taxes on transportation fringe benefits. Employers would generally work with a third party to administer these programs, similar to how employers handle other fringe benefit programs with payroll deductions.

Obviously, the NJSA Legislative Committee does not have any information that indicates if and when this bill could be enacted into law, but it thought NJSA's members may want to investigate the program and its benefits for both the staffing firm and employees.

More information on the program is located at NJ Transit's website at http://www.njtransit.com/tm/tm_servlet.srv?hdnPageAction=BusPassFAQTo. For third party administrators, the website lists the following entities: BusinessPass (NJ TRANSIT), Commuter Check (Wired Commute/Edenred), eTRAC (Benefit Resource Inc.), TotalBen LLC, TranBen Ltd., RideECO (Delaware Valley Regional Planning Commission), and WageWorks/TransitChek. Payroll service companies, like ADP, also offer a transit pre-tax benefit option.

The NJSA Legislative Committee would appreciate your feedback on the ease, difficulty, and expense (pro or con) of adding this benefit program so that we can better represent the staffing industry if these bills come up for consideration.
