In a recent theft case in Prince George's County Circuit Court, Mr. Messersmith was able to navigate the procedural terrain to his client's advantage and ultimately negotiate a disposition in which the State opted to abandon the prosecution in favor of a modest community service requirement.  In another matter before the District Court of Maryland, Mr. Messersmith represented a client charged with an alcohol-related offense.  In addition to vigorously asserting the client's innocence, Mr. Messersmith was able to successfully argue before the Court that the charging document was fatally flawed, resulting in dismissal of the case.  Mr. Messersmith has also achieved favorable results for his clients at trial.  In a recent multiple-defendant assault trial in the District Court of Maryland, Mr. Messersmith was able, through rigorous cross-examination of the State's witnesses, to expose the weaknesses in the State's case and achieve an acquittal for his client.  In another recent Circuit Court assault trial, after Mr. Messersmith argued his client's innocence before the jury deciding the case, the jury returned a Not Guilty verdict on all counts in a matter of minutes.*

Consequences of Criminal Charges/Convictions

Mr. Messersmith filed a Petition for Writ of Error Coram Nobis in the Maryland trial court in which the conviction was entered and successfully argued that the conviction was obtained in violation of the United States Constitution.  This resulted in the conviction being vacated, which led in turn to a favorable immigration outcome.  In two other recent cases, Mr. Messersmith argued on behalf of his clients and was able to persuade the trial court on various grounds in each case to modify and reduce the original criminal sentence handed down.  One of the effects of these modifications was to permit the clients to avoid deportation.*
