FEBRUARY BUYERS ABSORBING INVENTORY RAPIDLY

Naples, Fla. (March 20, 2026) – Buyers from the north and east descended on Naples in February resulting in a 55.9 percent increase in pending sales (homes under contract) compared to February 2025; and a 23.4 percent increase in pending sales compared to January 2026. Broker analysts reviewing the

February 2026 Market Report by the Naples Area Board of REALTORS® (NABOR®), which tracks home listings and sales within Collier County (excluding Marco Island), remarked that agents were busy in February in both the resale and new construction home markets.

THE VALUE OF BUYER BROKER AGREEMENTS IN A POST-SETTLEMENT REAL ESTATE LANDSCAPE

Every buyer agent in Florida is now required to have a written Buyer Broker Agreement (“BBA”) in place before showing property. The concept of a written agreement between a buyer and their agent is not new; however, the requirement that every buyer’s agent have one in place before showings is, especially in Florida. And while it is easy to view this as one more compliance obligation, a well-handled BBA is actually one of the most effective tools available for earning a client’s trust before the first showing even happens.


What separates the agents thriving under these requirements from the ones still fumbling through the conversation is not the form itself. It is whether they understand what they are presenting, can walk a buyer through it with confidence, and can clearly articulate what they do, what it costs, and why it is worth it. This article covers what changed, the forms available to help you comply, and how to use them in a way that sets you apart.

PROPERLY TERMINATING A NABOR® CONTRACT

While the purpose of this article is to focus on how to properly terminate the NABOR® Sales Contract, it is important to remember that, at the outset of a signed contract, the seller wanted to sell, and the buyer wanted to buy. Therefore, unless there are circumstances beyond one of the party’s control, on many occasions, there may be the opportunity for the parties to negotiate a settlement of the issues to keep the contract together and have a successful closing as the outcome.

THE NABOR® SALES CONTRACT FROM A LEGAL PERSPECTIVE

The NABOR® Sales Contract is arguably the oldest continuously utilized form of sales contract used in Florida. In fact, the NABOR® Sales Contract was first used approximately a decade before the first FR/BAR contract was. Every two years, a hardworking group of REALTORS® and attorneys gather in a room lined with mahogany wood shelves and many leather bound books to discuss, debate, argue, finesse and work through updates and refinements to the form contracts. That hard work and dedication has resulted in a balanced, well-reasoned set of contracts that have stood up to legal debate and review.

Naples Area Board of REALTORS® Vice President of Public Policy, Danielle Hudson, invited to participate in Senator Rick Scott’s Affordable Housing Round Table. Senator Scott discussed his recently introduced American Dream Accounts Act and asked for input from community leaders on attainable housing challenges faced by Collier County. 

PROFESSIONAL STANDARDS

REALTORS® are required to complete Fair Housing / Anti-Bias Training upon becoming a member, and every 3 years thereafter, coinciding with the Code of Ethics training timeline. This requirement is in addition to the Code of Ethics training. Qualified training must be of not less than 2 hours of instructional time. The training must meet specific learning objectives and criteria established by the National Association of REALTORS®. This requirement began January 1, 2025 with a deadline of December 31, 2027.

Board of Director’s Motions:

MOTION: Made, seconded, and carried that the RPAC Committee recommends to the Board of Directors of the Naples Area Board of REALTORS® and Real Estate Professionals, Inc. (NABOR®) approve local RPAC funds for four (4) Full page ads in the NABOR® Magazine at the cost of $1,418/ad (April 2026 – January 2027).

MOTION: Made, seconded and carried that the Board of Directors of the Naples Area Board of REALTORS® and Association of Real Estate Professionals, Inc. (NABOR®) approve sponsoring the 2026 Politics in the Park using up to $3,000 of local RPAC funds. The event will be held on June 16, 2026, at North Collier Regional Park.

MOTION: Made, seconded, and carried that the RPAC Committee recommends to the Board of Directors of the Naples Area Board of REALTORS® and Real Estate Professionals, Inc. (NABOR®) approve having a QR code on all NABOR committee agendas to invest into RPAC. The code will lead the member directly to the NAR RPAC investment website.

MOTION: Made, seconded and carried that the Legal Resources Committee recommends that the Board of Directors of the Naples Area Board of REALTORS® and Association of Real Estate Professionals, Inc. (NABOR®) authorize the Legal Resources Committee to approve the forms (the “2026 Forms Packet”) as created, revised, or deleted by the Legal Resources Committee.
