As REALTORS® we are bound by the National Association of REALTORS® (“NAR”) Code of Ethics which holds us to a higher standard than that of a real estate licensee. NABOR® proudly supports REALTOR® high standards of business practice and professional conduct to ensure ethical service to clients, customers, and other members of the public by enforcing various programs offered through its Professional Standards services.

 

One of the services offered by NABOR®, in an effort to promote integrity, credibility and professionalism, is the ombudsman program which is designed to assist REALTORS® , customers, clients, or other members of the public to problem solve real estate-related issues. Other services offered through NABOR®’s Grievance and Professional Standards Committees are mediation and arbitration dispute resolution, ethics complaint processing which includes a Citation Policy and Schedule of Fines, and REALTOR® Code of Ethics training classes.


NABOR®’s Grievance and Professionals Standards Committees oversee the Professional Standards process and compliance pursuant to NAR’s Code of Ethics and Arbitration Manual. At the forefront of every Professional Standards related matter is ensuring due process for all.

MARKET REPORT

NAPLES HOUSING MARKET REMAINS COMPETITIVE IN FEBRUARY

According to the February 2025 Market Report by the Naples Area Board of REALTORS® (NABOR®), which tracks home listings and sales within Collier County (excluding Marco Island), inventory increased 35.8 percent to 7,320 properties from 5,389 properties in February 2024. Overall closed sales decreased 9.5 percent to 584 closed sales in February 2025 from 645 closed sales in February 2024, but it increased 6 percent compared to closed sales reported in January 2025 (511 closed sales). And although the overall median closed price in February increased 4 percent to $650,000 from $625,000 in February 2024, the report also showed sellers taking action to stay competitive with 2,883 price decreases reported during the month to contend with the growing number of properties on the market.

OPEN PERMITS - A SOLUTION OF LAST RESORT

Open permits have been a constant headache for Realtors®, attorneys, and closing companies since they were added to the NABOR® contract in 2016. Closers were inundated with open permits, many being quite old. To make matters worse, some permits related to construction improvements that no longer existed. For example, a 15 year old open permit for an air conditioner might be superseded by a new permit, properly closed, for a newer air conditioner. The old air conditioner was replaced.

              

Experienced closers quickly adapted, and in most cases successfully closed the transactions. Often the seller was able to close the permit, in some cases that was not possible. What then? Many buyers closed if the open permit involved an improvement like the 15 year old air conditioner discussed earlier. Proper legal advice, context, the age of the work, and the extent of the work all played a role.

NABOR® INTRODUCES NEW FORM: “ADDENDUM TO SALES CONTRACT – ALLERGENIC MOLDS”

NABOR®’s Legal Resources Committee has recently released a new form addendum which, when used in conjunction with the NABOR® “Sales Contract (Residential Improved Property)”, permits buyers to treat elevated levels of penicillium aspergillus or other allergenic molds as a contractually-defined “Defective Inspection Item”. The introduction of this new addendum, entitled “Addendum to Sales Contract – Allergenic Molds”, permits the parties to agree, as part of the Sales Contract, that the elevated presence of penicillium aspergillus or other allergenic molds is to be treated in the same manner as the elevated presence of toxic or pathogenic molds. It is anticipated that the use of this new Addendum will be used by and be helpful to purchasers who may have certain health concerns relating to allergenic molds, including persons who may be immuno- compromised or have other respiratory ailments.

A GUIDE TO THE NEW MANDATORY NABOR® CONDOMINIUM ADDENDUM

The Naples Area Board of REALTORS® (NABOR®) responded to the recent Florida Legislature changes to Florida Statute Chapter 718 which governs Condominiums. The Addendum to Sales Contract Condominium, effective January 1, 2025, is the result of the changes to the Condominium laws. This is the first time NABOR® has removed references to Chapter 718 in the body of the NABOR® Contract. The new Condominium Addendum replaces and augments the NABOR® Contract and must be included with all new submissions of the NABOR® Sales Contract to preclude the Buyers right to rescind the Contract absent signing the Condominium Addendum.

(NABOR®) to explore AI Technology that makes NABOR® video content more easily digestible by members. The Digital Content Specialist can make recommendations that staff, our social media vendors and the Tech Team could explore.


MOTION: Made, seconded, and carried that the RPAC Committee recommends to the Board of Directors of the Naples Area Board of REALTORS® and Real Estate Professionals, Inc. (NABOR®) to approve the use of $1,500 in local funds to contribute to Commercial Advocacy Day; an event to be held in partnership with the Southwest Florida Commercial Alliance and Royal Palm Coast Realtor® Association.


MOTION: Made, seconded, and carried that the Board of Directors of the Naples Area Board of REALTORS® and Real Estate Professionals, Inc. (NABOR®) approve that the Symposium Economic speaker event be held in person every year and that the Expo be held as economically as possible, even if held in the NABOR® building.
