MARKET REPORT

ECONOMIC UNCERTAINTY AFFECTED HOUSING MARKET IN MAY


Motivated sellers in Naples who took advantage of getting ahead of the market with prices that pleased buyers found success during May as overall pending sales (homes under contract) increased 10.9 percent to 951 pending sales from 919 pending sales in May 2024. According to the May 2025 Market Report by the Naples Area Board of REALTORS® (NABOR®), which tracks home listings and sales within Collier County (excluding Marco Island), 2,023 properties on the market in May reported a list price decrease, 31 percent of the overall inventory. The number of homes for sale increased 23.9 percent to 6,524 properties from 5,265 properties in May 2024. But economic uncertainty is creating challenges for today’s buyer and seller, even in paradise.

A DIRTY DOZEN MISTAKES TO AVOID

REALTORS® make mistakes. Heck, we all do. But we should all want to minimize mistakes and the problems they can cause. This article will set out 12 of the most significant mistakes REALTORS® make in real estate transactions in the hope you will not make them.

Using a Seller to Buyer compensation form when the Listing Broker has already agreed to compensate the Buyer Broker is a poor choice. Some agents do this as a “belt and suspenders” approach and argue it is the same money. But, when a Seller has agreed to pay the Listing Broker and the listing allows payment of part to the Buyer Broker, adding a separate agreement for the Seller to pay direct is adding an additional expense. Since the Buyer Broker is limited in what the Buyer Broker can get paid by terms of the Buyer Broker agreement, there is no need for additional agreement for direct payment from the Seller. KEY UPDATES TO FLORIDA CONDOMINIUM LAWS FOR REALTORS®

Florida’s condominium laws have undergone significant changes in recent years, with 2025 being no exception, driven by the 2021 Surfside collapse and aimed at enhancing safety, transparency, and governance. These 2025 updates, most notably HB 913, impact condo sales, disclosures, and client advising. Below is a concise overview to keep you informed and help you guide buyers and sellers effectively.

1. Review of Condominium Documents and Buyer’s Right of Rescission

• Rescission Period. HB 913 included a subtle but very important change to the time periods practitioners are used to dealing with in connection with the purchase and sale of condominium units in Florida. Beginning on July 1, 2025, buyer will have seven (7) days, increased from three (3), after receipt of all required association documents to rescind the contract.

• Impact for Realtors: Listing realtors will need to obtain all required documents from the association and insure these documents are provided to the buyer as soon as possible to start the 7 day rescission period. Realtors will need to educate their clients to understand the impact of this change. (Read more in the link.)

THE DIFFERENCE BETWEEN "COMPENSATION" AND A "CONCESSION' AND HOW TO DOCUMENT IT USING NABOR® CONTRACT FORMS

The National Association of Realtors® (NAR) Settlement created some changes to our real estate business practices to preserve consumer choices regarding real estate services and provide greater transparency relating to broker compensation for those services. Different terminology and a multitude of new forms have understandably created confusion among real estate Sales Associates. For example, “commission” is now called “compensation” and a “credit” is now called a “concession”.
