Hello Members,


In late February, several NABOR® members and I attended the NAR REALTORS® Political Action Committee (RPAC) President’s Circle Conference in Las Vegas. Many of you are familiar with RPAC, our REALTOR® Party—a powerful alliance dedicated to protecting homeownership and property rights. Members can invest at any level, beginning at $30 annually, while major investors contribute $1,000 or more. The President’s Circle is made up of REALTORS® who support REALTOR®-friendly candidates at the federal level. The annual conference offers the chance to connect with colleagues from across the country and hear from influential political leaders who have helped advance key REALTOR® policy priorities. This year’s speakers included Senator Ashley Moody, Senator Cory Booker, former Senator Ben Sasse, and former Secretary of Transportation Pete Buttigieg, among others. It is truly an honor to support our profession in such a meaningful way, and I hope that many of you will commit to doing the same.

MARKET REPORT


JANUARY ACTIVITY SHOWS COMPETITIVE PRICING SPARKS SALES

Naples, Fla. (February 20, 2026) – Sellers in the Naples area housing market enjoyed increased buyer activity in January as pending sales increased 40.3 percent to 1,065 pending sales from 759 pending sales in January 2025. According to the January 2026 Market Report by the Naples Area Board of REALTORS® (NABOR®), which tracks home listings and sales within Collier County (excluding Marco Island), there were 2,053 price decreases during January and 1,906 new listings, which opened the door to buyers seeking more choices in all price points and home types. Broker analysts reviewing the report anticipated January would enjoy continued sales momentum, as seen during the second half of 2025, and point to the 9.2 months of inventory as a signal that Naples has returned to a balanced market.

PROPERLY TERMINATING A NABOR® CONTRACT

While the purpose of this article is to focus on how to properly terminate the NABOR® Sales Contract, it is important to remember that, at the outset of a signed contract, the seller wanted to sell, and the buyer wanted to buy. Therefore, unless there are circumstances beyond one of the party’s control, on many occasions, there may be the opportunity for the parties to negotiate a settlement of the issues to keep the contract together and have a successful closing as the outcome.

THE NABOR® SALES CONTRACT FROM A LEGAL PERSPECTIVE

The NABOR® Sales Contract is arguably the oldest continuously utilized form of sales contract used in Florida. In fact, the NABOR® Sales Contract was first used approximately a decade before the first FR/BAR contract was. Every two years, a hardworking group of REALTORS® and attorneys gather in a room lined with mahogany wood shelves and many leather bound books to discuss, debate, argue, finesse and work through updates and refinements to the form contracts. That hard work and dedication has resulted in a balanced, well-reasoned set of contracts that have stood up to legal debate and review. 

NEW LISTING OPTIONS AND NEW NABOR® FORM-OFFICE EXCLUSIVE OR DELAYED SYNDICATION

NAR has done it again. NAR changed the rules for MLS to allow new options. The options can be elected by sellers using NABOR® forms, but only if they use NABOR®’s new form “Addendum to Listing Contract Exempt or Delayed Marketing Election” or an alternative form that has been prepared by your Broker for the use of these new NAR rules. Please know that the use of either option is subject to approval by your Broker. Please ensure that your Broker’s Policy will permit you to offer either option to your Seller.

PROFESSIONAL STANDARDS

REALTORS® are required to complete Fair Housing / Anti-Bias Training upon becoming a member, and every 3 years thereafter, coinciding with the Code of Ethics training timeline. This requirement is in addition to the Code of Ethics training. Qualified training must be of not less than 2 hours of instructional time. The training must meet specific learning objectives and criteria established by the National Association of REALTORS®. This requirement began January 1, 2025 with a deadline of December 31, 2027.
