MARCH HOUSING MARKET:

NEGOTIATE YOUR WAY INTO PARADISE

Brokers reviewing the March 2025 Market Report by the Naples Area Board of REALTORS® (NABOR®), which tracks home listings and sales within Collier County (excluding Marco Island), agree that the Naples area housing market has become a buyer’s market – where the supply exceeds the demand – as reflected in a 36.1 percent increase in overall inventory to 7,483 properties from 5,500 properties in March 2024. Overall closed sales decreased 9.3 percent in March to 820 closed sales from 904 closed sales in March 2024, putting pressure on sellers to drop prices before season ends. Even with 3,305 price decreases reported during March – the highest on record – overall pending sales decreased 7.3 percent to 1,212 pending sales from 1,300 pending sales in March 2024.

THE DIFFERENCE BETWEEN "COMPENSATION" AND A "CONCESSION' AND HOW TO DOCUMENT IT USING NABOR® CONTRACT FORMS

The National Association of Realtors® (NAR) Settlement created some changes to our real estate business practices to preserve consumer choices regarding real estate services and provide greater transparency relating to broker compensation for those services. Different terminology and a multitude of new forms have understandably created confusion among real estate Sales Associates.  For example, “commission” is now called “compensation” and a “credit” is now called a “concession”.

OPEN PERMITS - A SOLUTION OF LAST RESORT

Open permits have been a constant headache for Realtors®, attorneys, and closing companies since they were added to the NABOR® contract in 2016. Closers were inundated with open permits, many being quite old. To make matters worse, some permits related to construction improvements that no longer existed. For example, a 15 year old open permit for an air conditioner might be superseded by a new permit, properly closed, for a newer air conditioner. The old air conditioner was replaced.

              

Experienced closers quickly adapted, and in most cases successfully closed the transactions. Often the seller was able to close the permit, in some cases that was not possible. What then? Many buyers closed if the open permit involved an improvement like the 15 year old air conditioner discussed earlier. Proper legal advice, context, the age of the work, and the extent of the work all played a role.

NABOR® INTRODUCES NEW FORM: “ADDENDUM TO SALES CONTRACT – ALLERGENIC MOLDS”

NABOR®’s Legal Resources Committee has recently released a new form addendum which, when used in conjunction with the NABOR® “Sales Contract (Residential Improved Property)”, permits buyers to treat elevated levels of penicillium aspergillus or other allergenic molds as a contractually-defined “Defective Inspection Item”. The introduction of this new addendum, entitled “Addendum to Sales Contract – Allergenic Molds”, permits the parties to agree, as part of the Sales Contract, that the elevated presence of penicillium aspergillus or other allergenic molds is to be treated in the same manner as the elevated presence of toxic or pathogenic molds. It is anticipated that the use of this new Addendum will be used by and be helpful to purchasers who may have certain health concerns relating to allergenic molds, including persons who may be immuno- compromised or have other respiratory ailments.

GOVERNOR APPOINTS NABOR® VICE PRESIDENT OF PUBLIC POLICY DANIELLE HUDSON TO COLLIER COUNTY HOUSING AUTHORITY

In March, Governor Ron DeSantis announced the appointment of four Floridians including Danielle Hudson, Vice President of Public Policy for the Naples Area Board of REALTORS®, to the Collier County Housing Authority (CCHA). The Authority was created by State Legislation in 1966 with the purpose of providing decent and safe housing for eligible low-income families, seniors and persons with disabilities. Hudson’s appointment will begin on April 15, 2025. Congratulations Dani!

NABOR®'s Annual Awards Banquet was held Friday, April 11, 2025, at Naples Grande Beach Resort. Outstanding members who volunteered their time and talents to better the organization, the real estate industry and community in 2024 were honored.


The REALTOR® of the Year recipient is Nick Bobzien. The Ad Miller Award recipent is Florida Housing Finance Corporation Chairman Ryan Benson. The Hall of Fame Award recipents are Paula Angelopoulos Urbinati and Pat Pitocchi.

BOD Motions:


MOTION: Made, seconded and carried that the Board of Directors of the Naples Area Board of REALTORS® and Association of Real Estate Professionals, Inc. (NABOR®) that President Terrilyn VanGorder appoint 2023 President Nick Bobzien as Chairman of the 2025 Nominating Committee and present the names of potential Nominating Committee members at the May 22, 2025, Board of Director’s meeting for the Board of Directors approval. If Past President Nick Bobzien is unable to accept the position as Chairman of the 2025 Nominating Committee, President VanGorder is authorized to appoint the Chairman based on the NABOR® Bylaws, Article XIII.


MOTION: Made, seconded, and carried that the Board of Directors of the Naples Area Board of REALTORS® and Real Estate Professionals, Inc. (NABOR®) that all committees must allow Zoom with the exception of Grievance and Professional Standards.

President VanGorder created a Zoom Task Force to establish Zoom (digital meeting) protocol with recourse. Named to the Zoom Task Force are President Elect Citrano, Directors Falzarano and Reinholdt, Treasurer Wright, and Vice-President Garry.


MOTION: Made, seconded, and carried that the MLS Committee recommends to the Board of Directors of the Naples Area Board of REALTORS® and Real Estate Professionals, Inc. (NABOR®) to approve turning off the field “Rear Facing: in the Matrix One Home portal (Shows as Building Facing). RATIONALE: As One Home only has a field titled “Building Facing”, our “Rear Facing” field is placed in there and it is implied that Building Facing is the front of the building. So, where we have Rear Facing South, which is desirable for sunsets, when placed in One Home it shows “Building Facing” as South which implies the front of the building faces South. It will still be in the MLS just not sent to One Home. 


MOTION: Made, seconded, and carried that the RPAC Committee recommends to the Board of Directors of the Naples Area Board of REALTORS® and Real Estate Professionals, Inc. (NABOR®), approve local RPAC funds up to $1,000 for the Business Partner Event on Thursday, May 29, 2025 at the Naples Conference Center.


MOTION: Made, seconded, and carried that the Board of Directors of the Naples Area Board of REALTORS® and Real Estate Professionals, Inc. (NABOR®) approve paying up to $500 per person for NABOR® Leadership Academy participants to attend the Florida Realtors® August meetings. They will be reimbursed after submitting proper receipts, after attending required meetings, and submitting a written meeting report.
