CREATE AI Act: Legislation To Establish the National Artificial Intelligence Research Resource. Time to finally codify NAIRR?
The plan for establishing a National AI Research Resource (NAIRR) has had a five year journey in the federal government. The NAIRR was first proposed in legislation back in March of 2020 as a shared national resource, providing cloud computing, curated datasets, AI testbeds, and educational tools to a broad community of users, ensuring that the future of AI is shaped not just by corporations, but also by entrepreneurs and academia. The law established a NAIRR Task Force which issued a 100+ page report titled "Strengthening and Democratizing the US Artificial Intelligence Innovation Ecosystem" in February of 2023.
The report was an implementation plan for NAIRR and one year later, in January of 2024 the National Science Foundation announced (HERE) the launch of the NAIRR pilot program. Nine government agencies and industry partners, including Anthropic, Amazon Web Services, IBM, Meta, Intel, NVIDIA, OpenAI and Microsoft and others, will provide model access, educational resources for experimentation, researcher collaboration, technical training for proprietary software and workshop opportunities. On Monday, Congressmen Jay Obernolte (R-CA-23) and Don Beyer (D-VA-8) have introduced H.R. 2385 the Creating Resources for Every American To Experiment with Artificial Intelligence Act of 2025 or the CREATE AI Act.
The legislation codifies the NAIRR setting up a formal governance structure with the White House Office of Science and Technology Policy and a Program Management Office at the National Science Foundation. NAIRR will offer researchers secure, tiered access to computational resources, structured Application Programming Interfaces or APIs for working with large AI models, access to interoperable datasets, and educational resources designed to broaden participation in STEM and AI research.
The bill to codify the existence of NAIRR has been referred to.the House Committee on Science, Space, and Technology.

New Office of Science and Technology Policy Director featured in the Wall Street Journal and WH Releases Top Priorities
Last week, Michael Kratsios was approved by the US Senate (74-25) to lead the White House Office of Science and Technology Policy (OSTP) and will begin by weeding through thousands of responses to the Trump Administration's request for input on their AI Action Plan. Kratsios will be working with AI and crypto czar, David Sacks, and Sriram Krishnan, senior policy advisor for AI. One of the top topics, as the Wall Street Journal outlines HERE is how to compete with the growth of China's AI industry.
The Trump Administration laid out three key challenges for OSTP:
- Secure the U.S. as the unrivaled world leader in critical and emerging technology.
- Enable the U.S. science and technology enterprise to achieve breakthrough discoveries and innovations.
- Identify how U.S. scientific discoveries can be leveraged to benefit all Americans.

Commerce Department Issues More China Export Controls and May Delay CHIPS Act Grants
The US Commerce Department announced last week (HERE) that it was adding more than 50 Chinese entities as it seeks to crack down on the nation’s artificial intelligence, quantum computing and military advancements. “We are committed to using every tool at the Department’s disposal to ensure our most advanced technologies stay out of the hands of those who seek to harm Americans,” said U.S. Secretary of Commerce Howard Lutnick.
It was also reported yesterday. that the Commerce Secretary has indicated that funds from the CHIPS and Science Act passed in 2022 under President Biden may be withheld. Bloomberg reported (HERE) that Secretary Lutnick’s goal is to generate tens of billions of dollars in additional semiconductor investment commitments without increasing the size of the federal grants.

Anthropic Wins Court Case Against Music Industry. "Fair Use" Question Still Unsettled
A California federal judge last Tuesday rejected a group of music publishers' request for a preliminary injunction to stop Anthropic from using their lyrics to train its AI models. The judge argued that the request was too broad and that the publishers didn’t sufficiently prove "irreparable harm". The question remains unsettled whether using copyrighted material for AI training qualifies as "fair use" under U.S. law. The growing market for AI training licenses suggests monetary damages could address any harm if the publishers win later. Anthropic has maintained that its use of such material is transformative and aligns with fair use principles, while also agreeing in January 2025 to maintain "guardrails" to prevent Claude from generating copyrighted lyrics.

House Bill To Report on AI in Precision Agriculture
As we have mentioned in previous newsletters and correspondence, almost every day another House or Senate bill is submitted related to artificial intelligence. The other day, Congressman Donald Davis (D-NC-1) submitted H.R. 1985 "Promoting Precision Agriculture Act" which included a clause directing the Ag Secretary to enhance the participation of precision agriculture in the United States with specific consideration of the impact of artificial intelligence use. The Act would also set standards and early tracking would be key for those interested in entering this market.
The House Agriculture Committee referred the bill to the Subcommittee on Commodity Markets, Digital Assets, and Rural Development

Other Capitol Hill Legislation NAIA is Tracking
H.R. 1736 "Generative AI Terrorism Risk Assessment Act" was introduced by Congressman August Pfluger (R-TX-11) which requires the Secretary of Homeland Security to conduct annual assessments on terrorism threats to the US posed by terrorist organizations utilizing generative AI applications. The bill is working its way through the House Committee on Homeland Security and in the Subcommittee on Counterterrorism and Intelligence for mark up.
H.R. 1802 “Safeguard Pets, Animals, and Research Ethics Act” or the “SPARE Act” introduced by Congresswoman Nicole Malliotakis (R-NY-11) promotes the use of artificial intelligence in one clause to provide more reliable and ethical research methods. The bill has been referred to a couple of House Committees and just landed in the Ag Subcommittee on Livestock, Dairy and Poultry last Thursday.

Alabama - Next State To Ban DeepSeek
Thirteen states have now banned China's DeepSeek from being downloaded to their IT platforms and used by state employees.
The following governmental bodies have banned DeepSeek from being downloaded by employees so far (recently added):
US Dept. of Commerce, NASA, the Navy, the Pentagon, the US Congress,
States of Alabama, Oklahoma, Tennessee, Montana, South Dakota, Pennsylvania, Iowa, Oregon, North Carolina, Nevada, New York, Virginia and Texas,
Foreign governments of Denmark, South Korea, Taiwan, Italy and Australia.
Tennessee became the first state to also ban Manus along with DeepSeek.
No hearings scheduled yet on the Senate (S. 765) or House (HR 1121) Bills to ban DeepSeek.
