THE ADMINISTRATION

The Government Accounting Office (GAO) Issues AI Report on Use and Oversight in Financial Services


On Monday the GAO released a report titled "Artificial Intelligence: Use and Oversight in Financial Services". This GAO report (authorized under the Dodd-Frank law) is provided to Congressional Committees and makes recommendations related to AI regulations at financial institutions. Their summary:


"Financial institutions’ use of artificial intelligence (AI) presents both benefits and risks. AI is being applied in areas such as automated trading, credit decisions, and customer service. Benefits can include improved efficiency, reduced costs, and enhanced customer experience—such as more affordable personalized investment advice. However, AI also poses risks, including potentially biased lending decisions, data quality issues, privacy concerns, and new cybersecurity threats."


The GAO specifically recommends that financial oversight groups offer more AI-specific guidance, pointing out that the National Credit Union Administration (NCUA) should update its model risk management guidance to include a broader array of AI models with more details on their use and risks. And added that the NCUA lacked the authority to investigate financial institutions’ technology services. The GAO had previously recommended to Congress that it grant such power to the NCUA.

The President Signs "Take It Down Act" to Criminalizes AI-Generated Deepfake and Revenge Porn


The President signed on Monday the TAKE IT DOWN Act or the "Tools to Address Known Exploitation by Immobilizing Technological Deepfakes On Websites and Networks Act" which is now a new law strongly supported by First Lady Melania Trump related to criminal prosecution for intentional disclosure and non-consensual release of intimate images. Senator Ted Cruz introduced S.146 in the Senate and passed the bill in February. The House overwhelmingly passed it in April.

Dept. of Commerce Rescinds Biden AI Diffusion Rule and Issues New Chip Export Controls


The Department of Commerce (DOC) announced last Tuesday a rescission of the Biden Administration’s AI Diffusion Rule, while rolling out additional steps to strengthen export controls on semiconductors worldwide. DOC issued the following statement:


"The AI Diffusion Rule was issued on January 15, 2025, with compliance requirements that were set to come into effect on May 15, 2025. These new requirements would have stifled American innovation and saddled companies with burdensome new regulatory requirements. The AI Diffusion Rule also would have undermined U.S. diplomatic relations with dozens of countries by downgrading them to second-tier status."

THE COURTS

More Hallucinations In Court: Anthropic Apologies Over AI Hallucination in Copyright Battle


Music Business Worldwide reported HERE this week that Anthropic lawyers had to apologize to a US federal court for using an incorrect citation generated by Anthropic’s AI technology in a court filing. Anthropic’s Claude chatbot didn’t invent an academic study cited by Anthropic’s lawyers in the case but it did get the title and authors wrong. As the opposing party tried to track down the study, it was realized that an error was made.


The court case in question was filed by music publishers including Universal Music Publishing GroupConcord, and ABKCO in 2023, accusing Anthropic of using copyrighted lyrics to train the Claude chatbot, and alleging that Claude regurgitates copyrighted lyrics when prompted by users. House Committee on Science, Space & Technology Holds Hearing on U.S. Quantum Tech Leadership


In December of 2019, President Trump signed into law the National Quantum Initiative (NQI) Act . The bipartisan legislation that established a coordinated multiagency program to support research and training in quantum information science (QIS).


Earlier this month, the House Science Committee held a hearing (details and watch HERE) on the US government status on NQI and providing additional support for the quantum industry to bring technologies to market, including assistance in developing the quantum workforce, investing in the supply chain, and the federal government serving as an early customer. The National Quantum Initiative Reauthorization Act failed in the last Congress but several new bills have been submitted just this month to advance (and prepare) for the next revolution in computing power:


S.1746 — A bill to establish the Commission on American Quantum Information Science Dominance, and for other purposes.

Forty State Attorney Generals Sign Letter Opposing the Ten Year Moratorium


On Monday, 40 State Attorney Generals, both Republicans and Democrats, signed and sent a letter to House Speaker Johnson, Senate Majority Leader Thune, House Minority Leader Jefferies and Senate Minority Leader Schumer pushing back on the proposed ten year moratorium on state AI regulations.


The letter HERE stated the moratorium would be “sweeping and wholly destructive of reasonable state efforts to prevent known harms associated with AI.” The AGS relayed that the moratorium would disrupt hundreds of measures being both considered by state legislatures and those that have already passed in states led by Republicans and Democrats.


Unfortunately, that is the problem...hundreds of measures impacting AI development and costly to track and abide by the different regulations in every state.


NAIA, since our formation, has consistently pushed the Administration and Congress to pass a comprehensive national law related to "data management" covering data security, data privacy and artificial intelligence regulation. It is a challenge for AI companies, whether large enterprises or startups, to manage the varying and numerous AI regulations being implemented by the states. We have proposed the "American Data Management & Artificial Intelligence Act" (HERE) as a solution.

Senate Judiciary Committee Members Introduce the "Artificial Intelligence Whistleblower Protection Act"


Senate Judiciary Committee Chairman Chuck Grassley, R-Iowa, is leading the effort to pass the Artificial Intelligence Whistleblower Protection Act in the Senate with support from co-sponsors Senators Chris Coons, D-Del., Marsha Blackburn, R-Tenn., Amy Klobuchar, D-Minn., Josh Hawley, R-Mo., and Brian Schatz, D-Hawaii.  


The Act is to provide explicit whistleblower protections to those developing and deploying AI. Chairman Grassley relayed "Currently, AI companies’ restrictive severance and nondisclosure agreements (NDAs) create a chilling effect on current and former employees looking to make whistleblower disclosures to the federal government, including Congress."

  

The legislation merges existing AI and whistleblower protection laws to shield the communications of current and former AI employees who make disclosures. The bill would also provide relief for AI whistleblowers who suffer retaliation, including reinstatement, back pay and compensation for damages incurred, where applicable.
