ADMINISTRATION UPDATE

TRUMP ADMIN REVOKES BIDEN AI EXECUTIVE ORDER FROM 2023:


As part of President Trump's numerous Executive Orders issued hours after his swearing in, he revoked Executive Order 14110 of October 30, 2023 implemented by the Biden Administration that was titled Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence. This halts many of the artificial intelligence policies being implemented across the Executive Branch of government and leaves a lot of questions on AI policy moving forward (see below).

WHAT AI POLICIES ARE IMPACTED BY THE NEW ADMINISTRATION:


  • The Biden EO directed the creation of Chief AI Officers in each department. HHS just, on January 13, announced (HERE) their new CAIO. The new Trump EO would remove this requirement BUT does it also eliminate those positions already created? How does this impact federal policies governing procurement and use of AI at each department?



  • From the Wall Street Journal: "Biden’s 2023 executive order asks AI companies to notify the government when developing powerful models that could affect national security, the economy or public health... The 2023 order included provisions about limiting bias and discrimination when deploying the technology, sections Trump bashed on the campaign trail while promising to repeal the order....smaller companies and investors including Marc Andreessen, a venture capitalist who supported Trump, said definitions and reporting requirements in the order would be difficult for many startups to meet, limiting innovation."


NAIA will be tracking how the new Trump AI officials, including AI & Crypto Czar David Sacks, plans for AI guidelines as Congress introduces more legislation impacting the AI industry.

BIDEN ADMIN LIMITS AMERICAN AI CHIP EXPORT AND MODELS ON WAY OUT THE DOOR


Last week, the Commerce Department's Bureau of Industry and Security issued a rule (HERE effective January 13, 2025) which places "controls on advanced computing integrated circuits (ICs) and adds a new control on artificial intelligence (AI) model weights for certain advanced closed-weight dual-use AI models." The ruling would impact 120 countries ability to acquire advance chips and places them into three groupings, (i) close allies (18 countries); (2) countries of concern (China, Russia, Iran, etc.) and (3) all other countries. "Allies" can receive license exemptions, "Concerns" get no exporting to these countries and "Others" are limited if they do not have .


The rule also includes specific export restrictions and licensing requirements for AI models.


  • Advanced Closed-Weight AI Models: A license is required to export any closed-weight AI model —“i.e., a model with weights that are not published” — “that has been trained on more than 1026 computational power.” Applications for these licenses will be reviewed under a presumption of denial policy “to ensure that the licensing process consistently accounts for the risks associated with the most advanced AI models.”
  • Open-Weight AI Models: The rule does “not [impose] controls on the model weights of open-weight models,” the most advanced of which “are currently less powerful than the most advanced closed-weight models.”

NViDIA called the rule "misguided" HERE along with numerous European countries. We expect the Trump Administration to use this ruling in trade negotiations with Europe and other countries.

TRUMP ANNOUNCES $500 BILLION INVESTMENT FOR AI WHILE BIDEN EO OPENS FED LAND FOR DATA CENTERS


President Trump announced an investment of up to $500 Billion from OpenAI, Softbank and Oracle to build out America's AI infrastructure over the next four years. The program would be called Stargate and first project is expected to be in Texas with 10 data centers. CBS reports HERE.


The Biden Administration last week also released an Executive Order (HERE) that was not reversed by the Trump Administration called “Advancing United States Leadership in Artificial Intelligence Infrastructure”. The EO opens federal land holdings for large-scale AI data centers and by March 31, 2025 DOD and DOE must launch competitive, 30-day public solicitations for private-sector proposals to lease federal land. President Trump was asked about the Biden EO at the Stargate press conference about opening federal land and he said "I don't see a problem with that". However, we can see the Trump Administration eliminating the EO's emphasis on prioritizing the use of renewable energy to power the data centers on federal sites.
