Burgum Outlines "Energy Emergency" Push to Nation's Governors to Support AI Power Demand
“President Trump understands that energy is the foundation of American prosperity. It’s the foundation of affordability, and it’s the foundation of national security,” stated new Department of Interior Secretary Doug Burgum at a meeting of the Nation's Governors last Friday.
He added, "One of the biggest technological advances in history, the AI revolution is going to require more energy than ever before. President Trump was just telling us today that we need to double the amount of electricity generation in our nation. That means we need more energy projects online now. If we're waiting 5 to 10 years to move these projects forward, we're going to miss out on this. China is building. They're months behind us on AI. It is a national security issue that we get this fixed."

Apple Commits to Manufacture AI Servers in USA as Part of $500 Billion Investment
Another week and another Administration announcement about a large investment in the country's AI infrastructure. Apple announced it will invest $500 Billion over the next four years including a factory in Houston, Texas for manufacturing of AI servers for its internal use and spend multi-billion dollars on the purchase of chips from TSMC's Arizona factory. The announcement follows the recent Stargate Project (NAIA Digest v1.2 HERE) announcement of $500 billion and Saudi Arabia investment of $600 billion (HERE).

NAIA Prepares RFI Response on White House Artificial Intelligence Action Plan. Send Your Recommendations!
The White House issued the following statement (HERE) yesterday:
“The Trump Administration is committed to ensuring the United States is the undeniable leader in AI technology. This AI Action Plan is the first step in securing and advancing American AI dominance, and we look forward to incorporating the public’s comments and innovative ideas,” said Lynne Parker, Principal Deputy Director of the Office of Science and Technology Policy (OSTP).
The AI Action Plan will define priority policy actions to enhance America’s position as an AI powerhouse and prevent unnecessarily burdensome requirements from hindering private sector innovation. With the right governmental policies, continued U.S. AI leadership will promote human flourishing, economic competitiveness, and national security."

Courts Concerned About AI "Hallucinations" in Legal Filings
A federal judge in Wyoming last week threatened to sanction two lawyers at the law firm, Morgan & Morgan, after they included fictitious case citations in a lawsuit against Walmart. One of the lawyers admitted in court filings that he used an AI program that "hallucinated" the cases and apologized for what he called an inadvertent mistake. Reuters reported (HERE) that seven cases have been noted for fictionalized AI generated fake case law, most notably a case with Michael Cohen, President Trump's former attorney. Cohen, who used Google's AI chatbot Bard, and his lawyer were not sanctioned, but the judge called the episode "embarrassing." The American Bar Association relayed to its members that they are at risk of discipline if court filings are false "even an unintentional misstatement" produced through AI.

House Bills to Allow AI to Prescribe FDA-Approved Drugs and Medicare Reimbursement for Use of AI in Remote Monitoring
Congressman David Schweikert (R-AZ-1) has introduced legislation in the House that would amend the Federal Food, Drug, and Cosmetic Act to clarify that artificial intelligence and machine learning technologies can qualify as a "practitioner eligible to prescribe drugs".
HR 238 the Healthy Technology Act of 2025 would allow artificial intelligence to prescribe if "authorised by the state involved and approved, cleared or authorised by the Food and Drug Administration and for other purposes." At this time, AI is assisting radiologists in their diagnostic capacity and Congressman Schweikert looks to be setting the stage for further use of AI in healthcare.
This follows the Congressman's introduction of HR 193 Maintaining Innovation and Safe Technologies Act which directs the Secretary of Health and Human Services to issue guidance on payment under the Medicare program for certain items involving artificial intelligence, such as remote monitoring that:
(1) use an artificial intelligence component (such as a continuous adjustment component); and
(2) transmit information to a health care provider for purposes of management and treatment of an individual.
Both bills have been referred to the House Committee on Energy and Commerce.

NAIA Delivers to House Energy & Commerce Members Our Response to HR 1027 the QUIET Act
The National AI Association released its first position paper this week and it was delivered to every Congressional Member on the House Committee on Energy & Commerce (54 offices) today.
Authored by NAIA's Senior Advisor, Andrew Loposser, it is titled, "The QUIET Act: How Over Regulation Could Hurt AI Innovation". We point out that the legislation recently filed and now in the Energy & Commerce Committee, is understandable in aiming to reduce the number of robocalls delivered to consumers. However, the bill's broad regulations could have serious unintended consequences for the artificial intelligence industry and other emerging technologies. National Leadership: NAIA Co-Chair Max Mets With Speaker Johnson
NAIA Co-Chair Caleb Max had the opportunity to meet with Speaker Mike Johnson on Monday and briefly discuss the artificial intelligence legislation in the House of Representatives (see above and previous newsletters on House bills). Caleb suggested and the Speaker concurred that the Hill should be working on a comprehensive AI bill. Specifically with a clause that supersedes the numerous and varied state laws now being imposed. The NAIA Advisory Council is also considering a push to form a Select Committee on Artificial Intelligence that will review and manage the numerous proposed AI bills (120+ in the last Congress). We will keep you posted.
