Understanding Internal Self-Referrals

In the complex landscape of healthcare regulations, physicians and healthcare organizations must be acutely aware of the legal risks associated with internal self-referrals. While internal referrals may seem like a natural part of integrated healthcare systems, they are heavily regulated under federal and state laws, particularly the Stark Law and the Anti-Kickback Statute (AKS). Violations of these laws can result in significant penalties, including fines, exclusion from federal healthcare programs, and even criminal liability.

Stark Law: A Strict Liability Framework

Stark Law, codified at 42 U.S.C. §1395nn, prohibits physicians from referring Medicare or Medicaid patients for certain designated health services (DHS) to an entity with which they (or an immediate family member) have a financial relationship, unless an exception applies. Question: Shared Service

Q: Compliance auditors stress that physicians must document patient management risk to set an accurate risk level. Yet, the E&M Guidelines don’t require this detail, leaving coders to score treatment plans without fully capturing the risk. Shouldn't coders also understand the condition’s pathophysiology to better assess risk?

A: While understanding a specialty's pathophysiology is valuable, risk should be clearly defined in the documentation to eliminate subjectivity. Coders and auditors should not assume or interpret risk; if it isn’t documented, it should not be inferred from the condition's pathophysiology.
