Senate Cloture Vote on CLARITY Act Fails | | The vote to advance the CLARITY Act failed in the Senate on Tuesday afternoon, due in part to concerns over the legislation's impact on bank deposits and the communities that banks serve. Thank you all for the calls, letters, and emails you've sent to our Senators. Your efforts made a difference! | The bill is not dead and can still be brought up again in this Congress, possibly after the midterm elections. What the vote signaled is that the concerns of the banking industry are real and must be addressed in the bill. | Following the vote, the American Bankers Association, Independent Community Bankers Association, Bank Policy Institute, Financial Services Forum, Consumer Bankers Association, Mid-Size Bank Coalition of America, National Bankers Association, and the Association of Military Banks of America issued a joint statement: | "The nation's banks continue to support creating a strong, durable regulatory framework for digital assets that will set the course for U.S. global leadership for decades to come. We believe Congress can accomplish that goal while protecting the bank lending that drives economic growth. As lawmakers consider next steps, we encourage them to adopt targeted changes to stablecoin yield policy. We stand ready to work with all stakeholders to achieve this important goal."
Language Needed to Strengthen CLARITY Act | Attached to today’s Bulletin is a letter that state bankers associations – including the NCBA – and ABA and ICBA sent to lawmakers in advance of the cloture vote, urging that they use the CLARITY Act to close the payment-of-interest loophole for payment stablecoins. | | | The letter argues that this will provide “the clearest path to achieving Congress’ stated objective of preserving local lending by reducing the risk of unintended consequences for local economies.”
